Letter before claim

Hello,

we brought a claim against a local service provider, after sending a letter before claim. We received no reply to the letter before claim, and brought a part 8 claim.

At the directions hearing the defendant produced a reply to the LBC as part of their argument to change to a part 7. They have now admitted they didn't send the letter to us, it was only a draft.

Have they mis led the court?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
