  • Money received AFTER Bankruptcy discharge

    My Neighbour was declared Bankrupt in 2012 and discharged a year later. She has since made a PPI claim against Abbey National (Santander) and was entitled to just over £1000.
    She made a claim and won however Santander have sent the money to her Official Receiver even though she was discharged many years ago. What will happen to this money? Will the Receiver simply send it on to her? Advice much appreciated

    It depends whether the PPI was incurred before her bankruptcy - in that case the OR will keep it - or afterwards, in which case it will be sent to her.

      But as the Bankruptcy was fully discharged 5+ years ago where would the money go to? Does the OR then open the case again and redistribute the money or do they simply keep it?

        The PPI refund was sent by Santander to the Official Receiver because it formed part of her bankruptcy estate. It will be used by the OR to pay any fees or debts that are outstanding. If there is anything left then it will be paid to her.
