  • Removal of 12 month old CCJ? Cabot

    Last year, I received a default judgement (from Cabot through Restons solicitors) as the paperwork had been addressed incorrectly and ended up at my neighbours flat below mine. The neighbours only passed it on to me 2 weeks after the judgement had gone through. No other paperwork had been passed on to me, so I knew nothing about it. I paid the full amount over 2 payments, 31st Jan and 28th Feb, but had missed the one-month deadline because of not receiving the judgement in time.
    I have done a full check of my credit report from all 4 major companies - the original 2 I used don't show it. However, my most recent search including the other 2 companies, do have it listed as satisfied.
    I am wondering if I should add a notice of correction to the credit file agencies, or would I be able to have it removed completely, on the basis that the address was incorrect. The solicitors, responsible for collecting the payments, said that the incorrect address meant nothing, as the paperwork had been sent to the address they had on their file and I had eventually received the notification of judgement. The address on my credit file is also incorrect but I haven't wanted to amend it yet in case it can be used in support of my claim for removal. I am currently wanting to apply for a mortgage and this, obviously, goes against me.

    N244 can be used to set aside, but cost £255 unless on certain benefits, but it will not go away unless you win a case in court. Set Aside Application

      Thank you for your response. I will submit that application. Will it support my application if I have a letter of consent from the original creditors for the judgement to be removed/set aside?

        agreed to set aside? if so what about cost? for it to removed it would need the set aside application nothing is automatic< and you will have to give reason for set aside , i.e. none receipt of original claim, etc

        before you go rushing off , give full information so that peeps can advise how to go about helping you?

          I don't want to dispute the claim - I owed the money and paid it in full. My query regards whether it needs to be set aside, as I'm not contesting the claim - just that had I actually received the paperwork, I would have paid it before a default judgement was granted and therefore not ended up with a CCJ. Hope that makes more sense.

            the idea of set aside is so that the case treated as not heard yet then you can sort it out without the CCJ on file, see what Diana M and others say before you do anything?
