    Is it worth making a claim against a person (with several children) sitting on benefits and having no property? How much is realistic to recover via deductions from his benefits?

    No. You can only recover money through an attachment of earnings - it won't work if defendent is self employed or on benefits.

      What would the claim be for in order to see whether you would have any chance of success before you spend money on court fees etc.

      Being on benefits doesn't automatically mean the Defendant would have no assets whatsoever if you were to choose bailiffs as an enforcement option.

      It also doesn't necessarily mean they will be in receipt of benefits forever and their financial situation won't improve.
