  • cireco and RLP?

Hello. About 3 months ago i had a very bad experience and was caught taking a box of bars from the range. It was approx £8 worth. No police were involved. My details were taken and I received a letter from RLP in the post a few weeks after. I know I shouldnt have, but I paid the money as I just wanted it all to be over. My mental health was not in a good place at the time and I did not need this on my shoulders.
Anyhow, I have just been given a new job (my dream one infact!). Today I received all the information through, and was asked to sign a form so that they could do 2 checks: The identity check and the enhanced civil recovery check.
I am very scared about this. Will I be on the database for Cireco? Will I lose my job offer?

It was a complete one off and as i say, i was in a very bad place mentally. I have had treatment etc and it has now resolved.

These individuals have either attempted to, or taken goods or services without intending to pay for them, either as a customer or an employee. Full report information returned includes the date, amount and type of incident and the status of the case.

You could send off a SAR to Cireco to find out if they do hold any data on you and if so what. Subject Access Request Letter

You could also check with/raise a concern with the ICO as Cireco do not appear to be a registered data controller. RLP ( retail loss prevention ) are registered, however Cireco is a separate legal entity and should have their own registration.

That doesn't help with the immediate employment issue though - did you keep a copy of the notice you had to sign agreeing for the checks to be made?

interestingly although CIRECO Ltd are a separate legal entity their only website (http://www.integrityscreening.co.uk/about.html) doesn't list its company registration number, place of registration and registered office address which it should as per legislation (Companies Act 2006 First Company Law Amendment Directive)

Yes I have kept the notice. It says ‘we conduct random enhanced searches to verify information about identity, honesty and criminal record. We use 2 checks: a civil recovery check and basic criminal record check to provide information. We use Cireco to conduct these: we reserve the right to terminate your employment based on these results’

Yes and I will explain this, in all honesty I don’t believe I did anything wrong. I completely justified it with security.
but I am concerned that I will be on the database with cireco, even though i have no criminal history

Ive looked through lots of forums, and it seems rare for a company to do these checks, especially as I have a completely blank enhanced DBS. but I am still very concerned that this will affect my employment.

des8 would Cireco be able to provide the basic DBS report Assuming that's what they mean by…
                    basic criminal record check
to prospective employers ? From reading they'd need to be registered as an umbrella company ? ( they're not ) https://dbs-ub-directory.homeoffice.gov.uk/

It's not massively clear so I've emailed DBS to ask what the rules are.

Indeed - Who would you report such a thing to?

Can you type up the permission section of the letter where you signed etc ? Or do a pic of the whole thing and cross out any identifying details.

Haven't a clue to whom to report it a failure to implement that regulation.
Possibly Companies House or Trading Standards or DTI.

CIRECO it seems check their own (RLP's) records to see if the person has ever been involved in a civil recovery incident, together with identity and credit checks
Their website doesn't mention criminal checks, which would mean a DBS check

So either the employer is misleading LM569, or RLP / Cireco are misleading the employer. Neither is good.

So it looks as though Cireco are setting themselves up as judge and jury for alleged dishonest acts.
