  • fitness superstore-in shop purchase

    Hi there
Can someone advise on this please? I purchased 2 pieces of fitness equipment on the 30th March. I initially paid a deposit on the equipment using my credit card and a couple of weeks later paid the balance online via a link the store had sent me. The items were delivered on the 25th April. 3 weeks later they came to actually set up the equipment. They had sent one young chap to do this and he could only install the treadmill as he said the other was a two man job. When I had a look at the space available I realised we were not going to have enough room for the other piece so I have asked the store if they will colllect it. They say they won't as it was purchased instore. Is there any way that I can get them to take the other item back?

Unfortunately for you any contract made in store is legally binding from the moment it is made.

Also they cannot be held liable if the item is too large for your designated spot, unless they misled you over the size of the item, or the amount of space it would need.
Could you have been given a wrong impression of its size?

Thank you for the response. I actually saw the items in store so no joy with that I'm afraid. The treadmill is quite a size which is the problem as I did not realise it would take so much space in the room. I am sure the guy selling the machine said we could return within 30 days but I will check with my wife on this, she has a better memory than me! When I made the second payment I did not receive a final bill from them, neither online or in the post. Would there be any leverage with that?

Your payment without an invoice is of no help, but if your wife agrees the salesman said you could return the item within 30 daysyou do have an argument.
Whether or not you can enforce that as a condition ofthe sale is another matter

My wife cannot remember whether the sales guy said that so looks like I will have to keep it. Thanks for your help though. Mc

                So your word against his.
If no possibility of the shop buying it back (even at a lower price than you paid) I suppose there is always Gumtree or eBay if you do not have room for it

I don't think they would. I will have to move a couple of cupboards to make room. Thanks again.Mc

I had the same issue. Last year I was inspired to do workout. I have ordered a lot of equipment, but I didn't consider that I don't know how to use it and what type of workout would be siuteble for me. I tried to find some information on it os where I could order workout plan. modernfit.com is the most useful source for it. Here I found a lot of articles on how to use my equipment and workout tutorials. I really recommend to research it, if you have some free time. WIsh you good luck)
