That changes things then, for the better.

Contact the dealer and make it perfectly clear to them that if they do not repair (or refund you for) the vehicle you will raise a complaint with Trading Standards for selling and allowing you to drive an unroadworthy vehicle and that you will also raise a complaint with your credit card issuer for a refund under Section 75, your card issuer is jointly liable for any goods purchased that are faulty.

No, it has to be £100 or more so Section 75 applies here

Ok...what I have done so far
is I sent the invoice for tyres brake fluid they agreed to so they owe me 400
i told them the sun roof is faulty too I took delivery on the 5th feb 2015
so I reported the sunroof on the 9th march
i have not told them the cost yet as Im waiting to see what they say
when I told them about the bald tyres...I quoted sales of good credit card trading standards etc....i,like this car but the sunroof will devalue if not fixed
i will give them a couple of days
i phoned cab so they know about it

If they don't play ball simply apply Section 75, that will get them to act

They did!,,, this dealer sells cars at 67k I bet that car sunroof works! And he's got nice tyres!
Mine has those run flat things.....I think Im going to have a battle on my hands he was arguing over £10...,,,
i understand they can the car back ...then that means I have no transport

Giving back the car would be a last resort, I'm sure he would rather repair the car than have it back on his forecourt with a faulty sunroof

Dear Sirs

I refer to recent correspondence sent to you advising there to be an issue with the sun roof.

You have requested that I deliver the car to your premises for inspection purposes which will involve me booking a day's holiday, which I course I am happy to do.

For your perusal I enclose an estimate of repair cost from the same company that repaired the brake switch. Startech Limited have advised not to open the sunroof due to a fault, closing thereafter may not be possible. Equally I have spoken to my local BMW dealer, who quote a standard charge for inspection only of approx £157.00.

I am trying to be fair and reasonable and help you as much as I can when dealing with issues on the vehicle since my short period ownership. Agreeing with yourself not to use my local BMW dealership, with a view to keeping costs to a minimum to give but one example.

For the purposes of clarity if I return the vehicle to your company for repair/replacement of the sunroof how long would you envisage this to take? As you know I will be without a vehicle for work and need to understand this.I would also need a courtesy car while the vehicle is being repaired. I am sure you will agree that to return and subsequently collect the vehicle your standard charge of £100 each way will have to be applied.

I sympathise that replacement of the sunroof appears expensive however I do not know of other companies specialising in sun roof repairs locally, whereby I obtain further quotes on your behalf.

Obviously I will help and support wherever I can. If you feel there are companies local to my area where I can obtain additional quotations for you, then please advise by return.

To this end I hope we can resolve this issue shortly and look forward to hearing from you in due course.

Well they have agreed to look at it, provide you with a courtesy vehicle whilst it is in for repair and possibly use the warranty to cover £500 towards the cost.

Is there a mini specialist nearer to you? If so provide them with the details.

Failing that then you have to at least allow them a chance to try and repair it/identify the fault and take it from there.

There are two options one sunroof (soft top specialist). He said he could strip it all. Back and he said I'm looking at £850
another ine who comes to the area Surrey sunroofs he would look at it
the warranty is their own. So. Not sure how he works that it doesn't look an external warranty policy
i thought I would be covered under sag act and credit card act

I would prefer myself to oversee repairs as I don't trust them after delivering a car to me with bald tyres....said they had serviced the car and they didn't do the brake fluid.... But do I have a choice?

You can respond to them and state your concerns, highlighting in detail about the issue with the tyres and how dangerous it was to allow you to drive it in that condition. That you have already spoken to Trading Standards(little white lie) and because of their track record so far you have no confidence that they will repair the sunroof to a suitable standard. Tell them you would rather have the sunroof repaired locally, to avoid unnecessary travel and that you will pass on the bill in full. Should they then refuse to pay the bill you intend to seek recovery through the courts.

See if that alters their position
