Re: Serious allegations made against me, totally untrue! I need help to take this fur

The police are now aware of whats going on but the latest tactic is unreal. I am really P`d off now! so here is the new revelations.

I receive a call from the police, yes! I have now been given the third degree about Cyberstalking!!!!! What the solicitors client is now saying is that, wait for it....................... I am now a Cyberstalker due to the fact that i have been on the solicitors clients LinkedIn webpage on a number of occassions looking at his public profile, I have also been on public websites looking at information relating to the personal family address of the solicitors client. JFC

I challenged the police that i am researching his companies of which he is a director of and should this person not want anyone to look at his profile on LinkedIn then all he has to do is make it private or even easier BLOCK ME! I also challenged them to tell me even one of the websites i have been on where this persons home address or any other personal information shows, I was told he doesnt have the website address but he can get it from the complainee, I asked why he is accusing me of something i havent done and why he hasnt got the information to back up the allegations he was actually making against me? At this point he got really annoyed and asked me if i wanted to spend some time in the cells. WTF?????? I was then told i was sending emails to his personal email address, i asked him what email address that was and he provided it (the email address was that of his company) which i obviously know for obvious reasons.

I then went on to mention the letter from the solicitor which was sent to me in june (i only recently noticed it, it was marked as spam ) and said it contained very serious allegations. He said that the complaint was ONLY to do with Cyberstalking and he wasnt aware of ANY mention of the allegations in the letter i received from his solicitor. Well Well the funny thing is, i now know, both the complaint he made to the police AND the letter received from his solicitor were made on the SAME DAY. Anyway the last words in a very annoyed voice from the police to me was that, if i look at his LinkedIn profile again he will see me charged with Cyberstalking and put in a cell, after that i was told to grow up and stop looking at things about him online! I had listened to enough, I asked to speak to his desk sergent, guess what, he put the phone down on me! yes the police put the phone down on me! But,

I phoned back and told them i wanted to make a formal complaint, I then got a return call advising that a sergent xxxxx will call me tomorrow.

I just cant believe that i was spoke to like a piece of dirt by this police officer.

Effectively this guy has got his solicitor to send a complete Bull brown stuff letter accusing me of threatening behaviour and ID Fraud but on the exact same day he is not prepared to back his allegations up and report the same to police. All he had to report to the police was, " I want him to stop looking at my publicly available LinkedIn page!" To protect everyone, i will not be providing a link to his publicly availabe LinkedIn page.

I am almost embarrassed to put this scenario online in this forum but it is so unreal i just cant help myself. This is supposed to be a high flying professional guy who has worked in finance broker/lender/intermediary for many years.

Anyway, the end result of my now new issue is, I am sick of this now and going to see the solicitor tomorrow to fight these allegations from his solicitor and the other one from the police.

justy incase anyone is wondering, yes he was a real police officer that called, i have verified that with his name and number when i called back to make the formal complaint of which i was provided with an Incident number.

      what a day

It does seem to have wound you up however.
I would still ignore it, you don't have to dispute these allegations, as that is all they are between a client and his "solicitor".
If they were to be made public, and there is no substance in them, it would be a different matter.
You say there is a current complaint about that solicitor which is being investigated? What is that complaint, to whom was it made, who is investigating it and how do you know about it? Are you involved in it?

I think there might be more to this than we are hearing, but with the present information IMO you should just ignore.
There is a current complaint against the solicitor, it is being looked at ( service & conduct) the relevent authorities are looking at it and i know about it because i made it on behalf of another.

I cant comment any further, I think this is a whole different ball game

When i sit and think about the big picture of all my post on this website, it is staggering to think about so many wrong doings by people involved in the finance industry and those directly or indirectly connected required to keep the wheels turning.

If you disregard some of the difficult to follow or confusing to say the least posts i have put on here, all due to the fact that i am trying to avoid anyone using what i have said against me, i.e the lender, the lawyer and the rest, rest assure, when the gigantic mish mash of legal issues still to deal with or currently dealing with come to a conclusion, I will spend a bit of time to sit down, relax and start from the beginning with my full story which i am certain will be a very good read. many will recognise the characters in my story but, many wont!

Have patience and humour me when you dont understand fully what i am asking or writing in my posts. Only those ppl directly involved will know its about them, but then again, only if they know its true!

Make sure you get a copy of the recording as all such calls are recorded AND the cops talking rubbish. He can't stop you from accessing public forums or any other social media only a court can do that. As for the threat of goal I suggest you make this threat prominent in your complaint.

Did the cop know there was an ongoing investigation into this solicitor's client? If so, I find it very strange that he's willing to jeopardize his career by intimidating a witness. I suspect the solicitor could be a mate of the solicitor or his client

Who is the investigating officer in charge of the fraud investigation and what rank do they hold? If an Inspector or above, they are in a position to give the sergeant and officer who rang you with a tirade of abuse a right royal roasting.

The scenario you describe is not unfamiliar to me. I came across this sort of tactic when I was a policeman. The solicitor is, in my view, simply begging the SRA to strike him off permanently.

Speaking to your solicitor is probably the best course of action to take.

Can i just request a copy of that call?

He did state very clearly that by looking at this LinkedIn profile it is Cyber Stalking and he can bring charges. I did mention that should he, or anyone else for that matter, put their profile on a public website for all to see, when they clearly have the ability to block individuals, groups or everyone for that matter but decide not to, then effectively he is authorising anyone to look at his profile.

The officer knew very well about the ongoing investigation which is in progress by my local police and i was a key witness but that didnt seem to deter him from his ways. To be honest, I did tell him i would not stop looking at any publicly available information on anyone or any business i felt the need to, also if i was commiting a criminal offence then why was he not acting on the complaint made by this guy, this is what really got him going the fact that he immediately slammed down the phone when i had enough of the way he was treating me and asked to speak to his sargeant was enough for me to make a formal complaint.

Anyway, I will wait for the call tomorrow from the sergeant, I will post the outcome

As suggested by BB you need to contact the senior officer who's investigating the original allegations & to which your witness

I'd like to see him try.

If he knew this, he should have referred the matter directly to the senior investigating officer in the case, not telephone you making threats and proving his name is Richard Head.

I hope he didn't break the phone when he slammed it down.

Anyway, I will wait for the call tomorrow from the sergeant, I will post the outcome.
It would probably be better to go straight to the Station Superintendent given the fact you are a witness in a fraud investigation and the behaviour of the officer who rang you.

I am wondering if the SRA can be persuaded to place restrictions on this solicitor practising or, better, suspend him from practising until the fraud investigation and any court proceedings resulting therefrom are concluded.

                            Your thoughts?

You have raised a new issue of complaint. The xxx is unable to deal with this issue of complaint at the moment as you have not raised it with xxxxxxxxxx in the first instance. You will have to notify the Client Relations Manager of xxxxxxxxxxxxx of this new issue and give them 28 days to respond. This is a legal requirement. Without taking this step first, the xxx cannot deal with the issue of complaint as it will be deemed to be premature xxxxxxxx x x x x x x x x x xx x x x x x xxxxxx.

Whether you raise this new issue of complaint or not is entirely a matter for you. I would advise that it would be likely to lead to a delay in the current complaint.

Part of my job is to manage your expectations as to what you can expect from the xxx. Assuming you raise this issue with the firm in the first instance, and then add it to your current complaint with the xxx, I must advise you that my initial view is that the issue of complaint would not be accepted for investigation. My reasons for this are stated below:

                            - Solicitors are obliged to act in the interests of their own clients and on their own client’s instructions. This means that the primary duty of care owed by the solicitors is to their own client. In addition, solicitors are entitled to accept what their clients have told them at face value unless they know such information to be false.

                            - There is no suggestion that the letter was sent by the solicitor other than in accordance with instructions given by their client. There is no suggestion that the assertions made in the letter are based on anything other than the version of events provided to the solicitor by his client. There is no suggestion that the solicitor knew that the assertions made on behalf of his client were untrue. It is plain that the client has contacted the solicitor and asked for action to be taken and the solicitor has written in accordance with the client's instructions.

                            - Against that background, for the purpose of assessing whether or not there is any cause for complaint against the solicitor for the act of writing the letter, the xxx must first ask whether it makes any difference if the assertions are ultimately found to be true or false. To put the matter another way, if a client asks a solicitor to write a letter such as this, and gives the solicitor an account containing a series of allegations against the intended recipient of the letter, and if the solicitor accepts the instruction and writes the letter, including repetition of the allegations, the solicitor does not give any implied warranty of the truth of the allegations. Provided he has information to support the allegations, in this case his client’s instructions, there is no duty on the solicitor to conduct further investigation before writing such a letter. That being so the conduct complained of cannot amount to a breach of the Conduct Rules.

Please note that the information I have given you above is only relevant to xxx xxxxxxxxxx and you are still entitled to raise separate legal proceedings against xxxxxxxxxxxxxxxxxx in relation to this new issue that you have raised.

Allegations from a solicitor by email? As other posters have noted, this is strange.

As there is a general principle that silence gives assent, it would perhaps be unwise to ignore it. If the email is genuine, you might email back asking for it all to be put in writing. Then you can, as MissFM suggests, respond very tersely - 'Your clients allegations are completely without foundation and are rejected in their entirety'.

Following which, as Bluebottle suggests, you advise the appropriate authorities.
