Re: Gobbys Holiday Hell battle with Thomas Cook

No news yet as I said its in the hands of a very very good firm of solicitors called Irwin Mitchell.they specialise in holiday litigation and have just had £2.5 million from Thomas Cook for a group claim so fingers crossed........They are working on a no win no fee basis so it must be a pretty strong case.

Very well done Gobby and I hope it costs them dearly in particular after the patronising drivel they sent in response to your initial complaint letter.

In addition, I sincerely hope that the "Customer Relations Executive" who attempted to fob you off is also suitably chastised for not recognising the seriousness of your complaint or your intent when you made it.

I also meant to tell you that if the family had to book another holiday in order to make up for Cuba that it is possible to recover the costs for it..............So holiday to Egypt may be recoverable from Thomas Cook too
it seems I chose the right company to litigate on our behalf!!!!!!!!!!!!!!!!

Serves them right..............it wasn't a holiday it was a nightmare.

Whilst that sounds like a good idea, Cetelco, I expect that they were just following the company's standard "fob all complaints off" policy and consequently they won't get any flak at all for their initial approach.

                  Right guys update..............................
My solicitor has recieved a bog standard reply from TC saying the will now investigate properly my complaints and that TC have in law 6 months to carry out their investigations before they have to take any action. However we are building our case ands getting it all sorted and ready for war!!!!!!!!!!!!!!!!
Solicitor says the more she talks to me the stronger our case appears............You wouldnt believe the sort of stuff that comes under personal injury...........even I was shocked!!!!!!!!!!!
You can even claim compo for having to care for the kids when they were ill and miserable......Anyway it seems its gonna be at least 6 more months but hey ho tis all money in the bank eventually(fingers crossed). However I must say I would much rather have had a nice holiday than the crap we did have.........Will keep you all updated as and when I hear anything.

Re: Gobbys Holiday Hell battle with Thomas Cook

                        Hi guys................
Well its all good news....I think!!!!!!!!
My solicitor is going to make a part 36 offer to thomas cook for them to settle without going to court and the amount is astounding tbh..............As there were 7 of us it is classed as 7 different claims so its near on £30,000 between us!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Thomas Cook have 21 days to respond and the solicitor has said its negotiable. They have come to a figure of £4500 for self hubby and eldest daughter and an amount of £4150 for my youngest daughter and the 2 boys and Tarus............
And to think I was willing to settle with them without a solicitor for £4000 of holiday vouchers!!!!!!!!!
Wil keep you all updated as and when I get a response.....

They also said they will be adding a further amount of 'special damages'.............i.e. they are trying to reclaim cost of holiday to Egypt as it was taken to make up for the Cuba fiasco!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
