    As Des8 has confirmed, adding insurance to a policy the policyholder has specifically asked a broker or insurer not to add is a no-no. This means the broker or insurer is no entitled to charge fees or premiums or for loss of commission. Any money they have taken from you under such circumstances must be repaid. The finance company may also be liable to repay monies to you.

    As for the elusive managers, if it were me, I would send an email directly to the CEO. Then they can ask the managers why they didn't want to take your call and explain what has been going on.

      how would the finance company owe me money also though? I'm sure they make it as confusing as possible so people who are not so clued up on all this just let it slide. To be honest if they hadn't of taken my money I wouldn't of looked into it all so deeply :/

        I can't see any harm in the bank conducting their own investigation to find out what has happened. They would need your consent under the Data Protection Act 1998 to ask for information from the broker, insurer and finance company. It may well help your case.

          If they have financed premiums for the Legal Assistance Insurance and this was not requested, they are not entitled to seek any money from you, whether directly or through the broker or insurer. Any payments they have received from you must be repaid to you or recovered from the broker or insurer.

            Regarding communicating with people like this I'm old enough to prefer Pen and ink and signed for delivery!
            But that's just me. I'm told it's now possible to send emails and get confirmation of delivery.
            You need to keep a hard copy of all correspondence and avoid discussions. It doesn't always go wrong, but when dealing with people who already have doubts raised about their probity it is wise to keep accurate written records.

              Would that amount to a lot of money? How would I go about claiming that back? Email the finance company stating I never requested legal assistance and due to being wrongly charged for it I'm requesting all money from that to be returned including premiums devolved from that?

                  If Onesure took identical amounts of money from your account monthly from Sept through to April this must be a CPA.
                  When you instruct the bank to cancel it, they must stop paying it, and refund any payments subsequently paid.
                  Unfortunately not many bank staff seem to know this, so refer them to this site

                    When I spoke to the staff at the bank they seemed pretty clued up with the CPA system. I made the initial payment over the phone when I took the policy using my debit card as payment. They then set up a direct debit payment from there on in. When I made the adjustment (third payment) again that was over the phone using my card to start that and they adjusted my direct debit. When I cancelled the policy I used my online banking and stopped the direct debit.

                    When I rang the bank today to ensure they put a stop to CPA they informed me that onesure hadn't used a CPA. They had just done a transaction (like I had phoned them) meaning they had stored my 3digit code on the back of my card also.

                      You need to establish how much the Legal Assistance Insurance premium was in total. The finance payments you made should include any interest payable. The finance company will almost certainly have to recalculate the finance payments and interest payable if the premium for the Legal Assistance Insurance was financed by them. Any Insurance Premium Tax charged will need to be recalculated and that applicable to the the Legal Assistance Insurance repaid. My gut-feeling is that the broker has some questions to answer.

                          Or can I state this fact in my letter to onesure? By telling them it wasn't warranted and I want to be refunded included any premiums derived. Would they then deal with it?

                            I would notify the FCA and let them know what has happened. However, try and find out as much as you can before doing so. If the broker and finance company will not play ball, then approach the FOS for assistance.

                              Before the FOS will take on a case, they will look to see if you have tried to resolve the matter with Onesure. They tend to get involved when a situation reaches deadlock.

                              You will need to ask Onesure why they initiated an insurance policy you did not request and why they have charged for it. They must address this.
