    No but the bank is talking nonsense. Under the payment services regulations they have to refund the transaction in full including the £110.00.

    Have you got an acknowledgement of the cancellation email?
    Have you clearly stated on an email that you have taken out alternative insurance from another company(prior to the money being taken out of your account)?
    Does the policy state that he is 16 years of age?(he cannot legally enter into a contract until he is 18 years of age)
    I am gonna have another read back on the thread cos a billion and one things comes to mind and even the question of whether you paid with a Visa Debit card comes to mind for a separate thing which might not be relevant....

      Right I will contact the bank tomorrow and state that info. Thank you.

      My acknowledgement of my cancellation email was to inform me that my son is the named policy holder and he needs to cancel, they were told due to them being unavailable I need to insure his new moped so I went with another company. This was mid April.

      Yea the policy has his date of birth on it.

      Many thanks for your help on this, any questions you have ill do my best to answer.

      Apart from from them having to pay the money back is there no punishment for doing what they've done? Surely they can't be allowed to get away with something like this?

          This is the email I sent on 14/04/14. (I've blanked the actual account number)

          Dear sir/madam,


          My son bought a new moped on 11/04/2014, I tried calling to change his insurance with you but was told your department was closed until Saturday at 9am. As I was at work till 4pm I tried again at 4pm to call but again the lines were closed. Due to the moped needing insurance I had no choice but to start a fresh claim so I have done so with motorcycle direct with the finance from highway. I'm unsure if this is the same highway choice who currently finance me now? Could this be looked into? My account with motorcycle direct is xxxxxxxxxxxxxxxx
          Surely if there are the same company nothing further apart from the moped details swapped as no longer own the Peugeot jetforce 50cc are needed.
          If they are not financed from the same company they please can you start the cancellation procedures.

                      I'd be careful using this argument as it is recognised that minors need to enter binding contracts for necessities, eg food and shelter, and also for employment purposes.
                      As RTA cover is required by any person using a motorised vehicle on the public highway, it follows that a 16 year old can contract a legally binding policy of insurance.

                      Also talk of "suing" all and sundry is IMO a bit early at the moment.

                      If OP goes to court they will possibly recover overpaid premiums. Looking at the schedule of costs and what has been collected the grand overpayment totals £18.85 less £8 odd already refunded by bank. The question of whether or not Legal Assistance was purchased has to be determined. (I think my maths are more or less accurate)

                      Yes, the bank has failed to act properly and the insurers have seemingly acted illegally, but the way to obtain redress is by direct complaint to those bodies' CEOs, as Leclerc advised.
                      Let the regulatory bodies deal with the sanctioning of the companies.
                      Altho' op is feeling aggrieved I doubt there is any advantage for her in pursuing redress through the courts, with all the stress that may entail.

                        Yeah I know your right, just feel if I had done that id be getting arrested with a hefty fine or jail sentence. Hate that just because there a company that they seem to just get away with it.

                        Im will email both CEO of bank and CEO of onesure today regarding it all.

                          Automated returned email off CEO of onesure (least it's a form of receipt) stating he's on annual leave and will return 14/07/2014. My letter stated he has 14 days to reply to me. What do I do now? Didn't really want to have to deal with the lesser powers that be
