  • What now?

    Sent off a Letter Before Action to the defendant about 7 weeks ago and they replied with their version of events stating that they had originally offered to pay 50% of my costs, after some careful consideration with my wife we decided to accept the offer reluctantly as we could do without the hassle of going to court, had some personal family issues and could do without the trouble at this present moment in time.

    So I wrote back and said after some considerations we would accept their offer otherwise we would have to pursue matters thru the small claims, that was 3 weeks ago tomorrow and we hand delivered the letter to the defendants door. I didn't put a time frame in the letter in which they had to reply but I expect the normal time is 2 - 4 weeks, so as they've not even bothered to reply do I just take them to the small claims or write again and forewarn them that this will be the case if I don't hear from them in the next 2 weeks?

    As ever any help would be gratefully received.

    Still not had a reply so it looks like the Small Claims Court is the only option.

    When making a claim can you go for the full amount even though I've said in a previous correspondence that I would accept 50%, feeling a bit cheesed off now and want fully reimbursed for my costs.

      If I were you I would write again withdrawing your acceptance of their offer unless it is paid within seven days and notify them you will be bringing court action for the full amount

          Dear Sir,

          As you are aware I have previously expressed my acceptance of an offer of settlement made by yourself in relation to the incident involving my animal and the damages flowing from the same.

          As you have failed thus far to pay the amount in question I wish to inform you that should cleared funds not be received within 7 days of your receipt of this letter, it is my intention to proceed with court action to reclaim the aforementioned damages and court fees.
