    Hope somebody can help

Purchased a Flueless Fire CVO Fire Jan 2013 Paid for Debit Card (NOt Credit Card)
Fire fitted gas safety checks all ok
Within three weeks fire caused damage to ceiling and wall Yellow Staining although on the website they claim there products dont stain
Sent standard letter asking for refund
Company say damage is caused by other ommision in property e.g Smoking and Scented Candles
(I do not burn scented candles and smoking in property is small and windows and doors are open)

31st May Trading Standards visit and take photos they contact local trading standards to company and investigate. Now they say they cant do anything a its a civil and not criminal. Also I contact Advertising Standards who advised that Trading Standards have more power.

Trading Standards say I should do a final letter and take them to court for a district judge.

Do I have to go to ADR first

Doesnt seem Trading STandards or Bank can help.

Do we have any template letters

    All help appreciated many thanks

    Re: dodgy FIRE Trading Standards

Trading Standards are worthless - all they are interested in is protecting big business. If you want to run with this, you will have to sue.

Can you prove that the fire caused the staining?

Can you prove that the site and installation were of the required standard?

Well done. Did the case go to court or did the supplier of the fire realise they weren't going to come out of it all that well and decided it would be better to settle out of court?

If the flueless fire was causing soot staining, then one must wonder:

          1. if the air intakes are adequate,
          2. whether the air intakes were blocked, and
          3. whether the fire was also producing carbon monoxide.

Did you suffer any headaches when you used the fire?

Celestine and her family were lucky. Others aren't so lucky. What you have reminded us of, Inca, and Lowry has highlighted brings home to us all that Carbon Monoxide isn't called "The Silent Killer" for nothing. All gas appliances should be checked on an annual basis, whether provided by a landlord, which is mandatory, or ourselves, which is not.

Plus every house should have a carbon monoxide detector fitted, we have two, and three smoke alarms in a three bed semi.

As well as a microwave detector to check that your AFDB (link) is working?

Absolutely. Celestine's experience shows that CO detectors should be mandatory. It is my understanding that moves are afoot to make them mandatory in rented accommodation. I have a smoke detector in my home which is hard-wired to the mains.

Will that still work if a fire starts from bad wiring?

Yes. It's fitted with a lithium-ion battery which acts as a back-up in the event of such an occurrence and, also, if there is a power failure.
