    Make sure that you keep a good, hot fire underneath your solicitors. Once LPA get wind of legal action, they may move quickly to get as much cash out as they can.

      A good legal professional will make provision to prevent that happening. If the police become involved, they may move like dickey lightning to stop any money being moved or removed.

              dont't know if they are or not. Neither me nor my family or staff are allowed on , if we try and go near they call the police, they have a 24 hour guard on the site, goodness only knows what that is costing.

              Question
              Can an lpa take control of assets not covered by the legal charge he is appointed under?, can he then use them to trade on the business and take income from them for the lender, i.e take milk from my cattle, feed them with my silage and sell the milk for themselves. The legal charge only covers the land and building.

              The unit has been advertised for sale and certain assets have been advertised with it that are not covered by the legal charge.The paperwork from my uncles estate indicate they belong to him, I fear third parties are going to get embroiled in this.

              The selling agents authorised say the vendor wishes to remain anonymous. Why would the lpa want to remain anonymous if everything is above board ?

                  Thankyou Cynthesis, it is as I thought but his actions go way beyond that. Since the day he came in he has used (excluding livestock) assets of my business worth at the going rate circa 20k.

                    Seems theres a lot going on here im thinking some good legal advice and if the OP is a member some advice from the NFU if these people are operating outside the law in either the way they have repossed the farm and have taken over the stock and feed they need to be made to answer for it in the relevants courts,
                    The more i read this thread the more i think i understand how the OP is feeling and hopeit gets sorted quickly

                      Brilliant idea Wales - the NFU has (or used to have) a good legal department- also hope that Kanine's legal advisor has extensive expertise in agricultural law.

                      As regards the cattle, am personally appalled that they are threatening to slaughter a perfectly good dairy herd for no good reason and would worry greatly about the welfare of the herd if that is their ultimate intention as it would give them no motivation to ensure that they are well looked after - quite the opposite. I can only begin to see, Kanine, how awful this is for you and feel such sympathy FWIW but would suggest that it probably is quite urgent to get someone like the RSPCA or DEFRA inspectors in there (they cannot refuse them entry). If the animals are being neglected or ill-treated (apart from the inherent awfulness of that) it may also rebound on you.

                      Really hoping your solicitor will sort this for you.

                            I agree with MissFM about calling in RSPCA or DEFRA to check the cattle are being looked after properly. Normally, they turn up with the police in tow, which should have the LPA receiver and Derek Fradgeley producing more greenhouse gas than the cattle ever could. Do this as soon as possible.

                            The LPA receiver and Outlook Finance seem to be behaving more like the Mafia than respectable businesspeople going about things in a lawful manner, which leads me to conclude, "Is what they are doing lawful per se?" My gut-feeling is, certainly, that something is definitely not right, but I would not be surprised to learn that Fradgeley had taken on too much in the way of deficit funding, his ship is sinking as a result and he is frantically trying to bail the water out by calling in LPA receivers to repossess businesses, etc., which he, probably, has no grounds in law to do so. Do not be surprised if you end up calling in the police.

                                The first court hearing will be shortly.The Lpa is as elusive as the scarlet pimpernel, sadly it is a total debacle.
