    Hello All

    Just a brief update,

    It appears the Property has been taken off the market.
    Another farmer has been given a tenancy by the LPA ( a tenancy at will which can be ended at any moment) we have an agreed inspection on site next week.
    My solicitors have taken matters to the High court and proceedings have been issued on two fronts, both in terms of my dairy herd and the property.
    I have met with my MP who was appalled at my treatment but as the rest of us was more appalled at the law that allows this.

    For your information In Scotland no property can be dealt with in this way,lenders must obtain a court order before they can tke possession of a secured property.

    George Eustice who is also an MP is I beleive working with others in parliament to have reforms brought to the English law.


    I will update further as things develop.

        We have seen cattle and all is well at the farm on a practical level. Proceedings are now underway in the high court against Our Mortgagee and the LPA receiver.


        We had to change solicitors as our original outfit were way out of their depth but current team are well and truly on top of it.

            The mortgagee we have issued proceedings against has not furnished us with VAT invoices on an agreement we are in dispute over, we have paid the sums due to him but we have not been able to recover it from HMRC, it is a serious amount of money that has been paid over.

            My solicitors asked him to furnish the invoices to us a month ago and nothing has been received. The point is he will not have had to pay the vat over as he will not have invoices to put through his books yet he has taken it from us. The sum is close to 10k.

            I struggle with the HMRC as to where I make the complaint too, does anyone know the correct department or at least someone who will actually do something about it within HMRC ?

            As said in my last post things are progressing but all has gone deadly silent and things emerging that are not good about conduct of mortgagee and LPA, my solicitors are saying the silence is deafening but there are court deadlines and significant disclosures to be made by our Mortgagee. I will update as it unfolds.

                  Hello All. Just to update briefly. The mortgage that is subject to the LPA appointment is now under scrutiny as it appears the sums claimed on it may not be accurate as they were reated by rolled up amounts from fairly small advances, it is just not clear yet but something like 10x the original advances in just 2 years. Obviously I have been paying interest on money that was never lent. I am speechless but in a sense relieved as we could not make sense of the vast sums secured by the legal charges. It is going to take a very long time to unravel it all but we know what has been done and we are now attacking at full tilt. There should be no such thing as an unregulated lender,no other profession can "opt out" of it's regulations and I suspect DEFRA would not be to happy if a farmer said his business was being run outside the regulations!! So I can do what I like. I know the courts are there but they are no deterrent as most people are totally overwhelmed by there premeditated actions (unregulated lenders)
