Does anyone knbow how long from issuing a cc summons to know the outcome,and what happens in beween,is thjere any more contact or do they just read both sides od story from complainant and defendant

Thank you, i got the forms returned this morning,have to do it all again, i am the claimant and i have to make copies to send to the defendant it seems
I am going to see CAB i think, will make an appointment on monday
I have never done this before so really dont have a clue

Have a look at the Civil Procedure Rules (available online or I seem to remember a link on this site). Also look at direct.gov.uk making a court claim for money and money claim online. These should answer all your queries. Here's a link:

I have now done everything requested by the court, and i have received notification that the defendant is deemed to have received court papers by the 16th [today] he has until the 30th to respond
Also the defendant was taken to court last month for receiving goods known to be stolen, might not make any difference, but thats the kind of person he is,

Keep us informed if you need any further advice on this. The stolen goods bit will be a criminal matter, your case appears to be a county court claim, a civil matter.
Phone the court on the day the response is due, just before 4pm (counter closing time). If he hasn't responded, enter a default judgement immediately the next morning. You can get the court form online, or the court staff will give one to you. If you can go to the court office, the staff will help you complete it.

Thank you for your last post,the 14 days are up tomorrow,,and i have heard nothing from the second hand dealer who sold me the suite
Should i inform the court on the form they have sent me as a request for Judgement, i wasnt sure if he would have had to inform the court and they inform me, i have heard nothing,from him,
A the defendant has nos not filed an admission or defence to my claim or an applicationto contest the courts jurisdiction
I know it sounds straightforward enough, but just want to be sure,i stated the amount i wanted back ,basically just the cost of the suite and postal expenses plus the extra i had to pay for another suite compared to what i paid the dealer,
If he is not going to take it back i will also have to pay someone to take it to the tip,as that is all its fit for,which will be another £20,

The time has passed now for the defendant to have eith refunded my money, or denied the claim, or to respond,i have heard nothing, should i now send in the request for judgement,or should i wait for the court to inform me of the next step,
I dont know if they do this ,and if so how long it takes for them to inform me

I rang my local court and was advised to wait a few days after the 14 days for the defendant to respond were up, so i am going to send request for judgement off tomorrow

Sadly the court system can be very slow. It's usual for them to wait at least 7 days after the time for response has expired and even then if a defendant submits a late defence during the period you're awaiting the court to enter judgement by default the court may still consider the case open.
If/when you get judgement you will have to decide on means of enforcement. BEFORE doing this check on http://www.trustonline.org.uk/ to see if there have been previous CCJ's against the company and if they have been satisfied (paid).

Even though you may gain a CCJ against someone there is still no guarantee you will ever receive the money owed. Some debtors treat this as a game or profession and are very adept at dealing with all the methods of enforcement that may be tried. Don't be surprised to find you have dealt with a "phoenix" who does this many times and just starts again under a new name - builders & secondhand car dealers spring to mind.

I am still having problems with this court claim for 3 piece suite which i bought second hand,which was quite badly marked, where i wasnt able to see it,and it wasnt pointed out to me
I have now applied for a hearing,
The second hand dealer has defended my claim against him, and lied again and again, about what was said at his shop,he wasnt the person who served me,he has only the word of the assistant,,
I contacted him to see if we could come to an agreement about refunding my money,and taking the suite back, or should i carry on with the CC Claim,
His answer was "you carry on love,i have got a solicitor",iit was meant to worry me i expect, but doesnt
This man already has a conviction for receiving goods knowing them to be stolen
I dont know anything about courts, so i am hoping that someone will enlighten me about what chance i might have to actually tell my side of the story,
I have of course said what the reason is i am suing him, but would like to add more of the details.like my son was giving me some money for my own suite towards another, but after letting him know i had paid a deposit on one,he said he wouldnt be able to give me the money for a couple of weeks, i said to the sales person, i am sorry i cant have the suite after all, and explained why, the salesman said well you have lost your deposiot, i had only handed it to him about 20 minutes before, which i pointed out, and said it would leave me short of money inj that case, then the shopowner turned up with another man,and joined in, but what also annoys me is that the salesman had just told me he had already given a polish man his deposit back the day before, , maybe if i was a big polish man i might have got mine back too, as it happens i am a pensioner, then all 3 men started telling me it will clean up,so dont ask for your deposit back, which was very intimidating

URGENT ;I need to download a form to apply for a court hearing, i was told i was sent one out on the 13th, but i havent received it, i have only until the 30th to get it in
Can anyone tell me what form it is, i think it is an M? or N something, ASAP PLEASE

to apply for a coourt hearing is done through an application order via an N244 form
