Re: how long does county court take to inform you of outcome
If you have read earlier posts of mine regarding "Rights on second hand goods" you might remember, it was regarding a second hand leather suite i bought, which was in much worse condition when it was delivered and had a burn on one of the seats, which wasnt pointed out to me,and was too hogh up on a stand for me to see, the salesman showed me a chair in reasonable condition for the price,
Also my son was going to buy mine,as he had moved and needed furniture, i couldnt afford another until i got the money off him, he then said ,after i had left the deposit he couldnt pay me then as his wage was lower than he thought, i[Irang him straight after i gave the man in the shop the deposit] i said i wont be able to have the suite after all,as it will leave me short until my son pays me,
The salesman then turned quite nasty annd said well you cant have your deposit back, so there are 2 aspects to this case, although he had just told me had given a polosh man his deposit back, then 2 more men turned up, and said we could have sold it to someone else, and as far as the condition of the suite is concerned,it will clean up ok, if it doesnt, put some covers on it
The shop owner has lied in his defence saying i said dont worry i will clean it up.
Its very complicated really,as far as the court is concerned the deposit doesnt really come into it, its the codition of the suite, the shop owner is saying to the court that i must have made the marks and the burn on it,
Also underneath the cushions are fi;lthy, with fag, ends, burn holes and filter tips, and sweet papers, i have a feeling its been part of a house clearance
Within 10 days i got another suite with money my daughter lent me, so since getting the first one,the only chair in good condition, used was by me, and the rest has been covered,he is arguing that i still have the suite, well of course,i want him to take it back
I hope you can fathom all this out
