  • rights regarding second hand goods from trader

I bought a suite from a second hand shop, which i found after delivery had 2 burn marks on the setteee cushions, when i looked at it in the shop i thought it needed cleaning up a bit, and the seller said with some leather cleaner it would clean up well
The settee and 2 chairs were above my eye level, but he brought one chair down to show me, the condition of that was ok
After it was delivered i found the burn marks, i did ring consumer protection and was asked if these were [pointed out to me,which of course they were not,or i wouldnt have bought it, also the other chair was badly marked, and is only fit for tipping
I was advised to send a letter giving the shop owner 14 days to respond, and asked for a refund
I have heard nothing back, i am fuming, i have had to put a throw over the setteee and 1 chair, would it be worth taking it further
The suite wasnt expensive, but all i could afford at the time, but i wouldnt have bought it with burns on it if i had known
I am only 5 ft tall,so couldnt see the cushions on the settee or chair, only the front ,but was assured it would clean up ok,which it hasnt, and looks dirty
Looking back i think the man just wanted rid of it
Under the cushions it is full of cigarette burns, and sweet wrappers etc stuck in the sides

How much did you pay for the suite, Valerie?

It was only £150, but still should have had faults pointed out, i really rushed into buying it as i let my son have mine,he had just moved into a new place and i had said he could have it, i thought this would do until i found one i liked then sell this on, but i wouldnt be able to give it awaywith the burns on it

You've given the shop owner a chance to sort matters out, Valerie, and he has done nothing. So, I'd send him a Letter Before Action, giving him 14 days to repay the £150 and collect the dodgy suite he sold you and see if that makes him smarten his act up. If it doesn't, then fill in an N1 and take him to the Small Claims Court.

Thanks Bluebottle, i have done that and the 14 days from date of writing was up on the 10th, no response, i rang consumer protection again, and they say write again giving them another 7 days, if still no response,go to small claims court, but also said it might cost me more than its worth
I am writing again and sending by recorded delivery tomorrow, keeping a copy

Oh, what is an N1 a court form? Also no fire warning label on suite, isnt it an offence to sell without one?
