  • Miss Sold Sofa

    Hi all.

Back last year myself and partner were preparing to move into our first home together.

We purchased 2 sofas from Homebase around end of March 2011 for a delayed delivery for 7th June 2011.

It was a hectic month of deliverys for us as we both needed a lot of new items for our home and combined with working was a difficult move.

Past weekend gone i noticed that there was a tear on the seam of one of the sofas on the rear, and this is behind the back cushions i knew it was not from us catching anything and was exposing the foam.

I dug out my paper work to see what the situation would be with warrenty.

To my shock i have discovered the sofas we had delivered were both actually smaller than the ones we had bought! The width should have been 195W Cm but ours are just over 170CM!

Fortunately with all internet orders i take a screen grad at time of order and a print out of full item details and both clearly state 195CM width.

I have contacted Homebase and await there response.

Can anyone please advise on the legal position. I'm not happy that we have been sent smaller sofas than we paid for. Obviously time has past but you should not be expected to have to measure new furniture and only really came to my attention because of this tear to the material.

    Thanks

    Hi rizel23,

Only my opinion, but as the goods supplied were not 'as advertised', you have a reasonable complaint via SOGA, especially, as you have stated, the 'size' issue is not obvious.

Thank you for the comment charitynjw and the link.

I tend to agree with you, fortunately having the proof of the screen grab and printed item page stating the size i can't see how they can get out of this, I'll await their response before quoting SOGA acts i think, common sense should prevail here i think from Homebase its almost black and white.

Just an update, after forwarding the screen grab and order conformation Homebase rang to arrange a collection date so looks like a result!

As you've had "the wrong sofa" for ten months, one might suppose you had accepted it.

            Hi rizel23,,

Splendid - have your tape measure ready!

& I even resisted the temptation of saying 'sofa, so good!'

            Oh!

            Damn!

but by surly making contact with Homebase and notifying them of there error was a clear sign of not accepting it

I think it was purely down to the evidence i had on them clearly stating the size at time of purchase and then the delivery note showing the items listed on the website at time were the same as on my delivery note (item codes matched), i.e they had delivered to me goods that were not as advertised under SOGA. Also the fact they had updated the size at a later time on the website after purchase and not notifying previous customer of there mistake would not look like good business practice.

                    Re: Miss Sold Sofa

collection date has been arranged for early May and refund to be processed 3-5 days after that, i must say very good customer service from Homebase, it only took one mention of the SOGA with the screen grab and order prints and they were ringing me to arrange collection.

We shall defiantly give them the opportunity to have our money again when we purchase new sofas after our house move.
