    Yesterday my o/h received an email from Credit Expert, intimating that his credit rating has drastically improved

    'It's great to know that you are in a good financial position (name)'

    In addition it gave him links to the following
    1.Balance transfer card from Nationwide
    2. Personal loan from Nationwide

    So it states his name and the whole thing looks like he has an improved status and it is advising him to check his status. It then leads you on to get a report and of course pay. When he did so, he found that nothing had changed and he had paid the fee for the report for absolutely no reason.

    He phoned Experian and they said these were sent out to everyone regardless of their status and have now refunded the fee he paid to them as the email was misleading.

    Don't be taken in by their sales emails it is just a rouse to get you to pay them some more money and to take up one of the deals offered as above so are they now earning out of that as well????

    LOL had the same email , only problem is my rating has been 999 for about 2 years now and was checked 2 weeks ago. They really trying to gain me that non-existent extra point as I thought 999 was highest for Experian!!!

      A further email arrived this evening to my o/h following yesterdays email but this time alerting him that there has been some irregular activity on his account he obviously got very worried so he followed the email link which took him to the page where it asked him to re-join and of course pay a fee.

      He feels that this is unfair trading by frightening you into beliveing that something has happened and therefore requesting further payments from you.

      This we believe is extremely naughty of them and morally not correct.

      Who regulates these people that they can mislead you twice in two days just to earn some money from you. He would like to make a complaint, any suggestions as to whom a copmplaint should be addressed??????

          Possibly that fantastic piece of legislation............... if anybody used it, rather than just quoted from it, CPUTR 2008.

            Just copied this from one of your earlier threads - just have to understand what or how it is or can be used???

            74 | PART 4 | annex a illustrative examples
            (3) A trader employs various practices to recover debts owed by consumers. He sends letters to consumers containing demands that state: ‘pay now or we’ll take criminal proceedings against you in court’, when such action cannot legally be taken. Some of the demands that he sends to consumers are made to look as if they are court papers, although they do not have such status. The trader offers consumers an opportunity to ‘reduce’ their debts, and delay the requirement to repay, by signing up to a debt consolidation loan product with a ‘very advantageous’ interest rate. He tells consumers who say that they cannot pay their debts that they have no choice but to sign up to the product offered by him, and states that it has the lowest interest rate on the market for such a product. In fact, the interest rate on the offered product is unusually high.
            • The letters sent to consumers by the trader could be misleading actions for the purpose of regulation 5, as they contain false and/or deceptive information, or deceive through their manner of presentation.
            • These misleading actions could cause the average consumer to take a different decision (for example, to pay the debt sooner than he might otherwise have done, or to sign up to the offered debt consolidation loan product more hastily than he might otherwise have done or without first shopping around for alternative and more advantageous means of consolidating his debt).
            • Several elements of the trader’s practices could be aggressive practices (that is by threatening court action). All of these practices may cause the average consumer to be frightened or to feel unduly pressurised. This is likely to significantly impair consumers’ freedom of choice so as to cause the average consumer to make a different decision.

              I honestly cannot be ar$ed to read the whole lot again, but here is one sentence from the first paragraph of the OFT Summary of it:

              The Regulations introduce a general duty not to trade unfairly and seek to ensure that traders act honestly and fairly towards their customers.

              You ought to read it Tutts - it should be a powerful piece of legislatioin, but it is very rarely used.

                Unfrotunately the CPUTRs are not individualy acionable, so iunless you camn show that they make a habit of this and then get the OFT to take action they are not a lot of use.

                What i do is join up and give them my debit card, they have to give you 30 days free so then you use the new legislation to cancell at your bank before they take the first payment.

                  They are also not actionable by consumers, only official bodies who tend to be rather spineless.

                  Love your approach to getting your CRF! I'd use it to get mine, but I prefer not to know! lol

                    Some other not so happy chappies, mostly about their free 30 day trial and getting out of their grasp. Some other stuff though about how underhand they can be.

                      Yes that was in the bad old days when you could not stop your repeat authority just by ringing your bank , now of course you can.

                          I dont think many are aware of the new regulations, banks will refer the customer to the payee unless they are reminded of their obligations.
