    No - All i purchased was flight only with Airflights the goldtrail ones on Cap One card the Kiss ones on the HSBC card. (why do you ask please ?what if any difference does it make?)

    The flights I lost on the package I bought from Holidaymate were goldtrail but claiming that loss back via ATOL

      Also this was in my earlier posts and following your last question and no reply yet I can't wondering if the FO statement I did question is going to stop me having the valid claim under S.75

      (Why are you still asking questions if you have doubts about the answers you are receiving? I didn't have any doubt that I had a valid claim against the HSBC under S.75, until I read the FO paragragh in the link you sent me stating that if I booked flight only via a travel agent I cannot normally claim etc etc. )

      Please can you advise as to why you ask the above post question. Also what I should do now that Cap One replied to my LBA. whats my next step.

            Sorry for back to back post but I felt I had no option as I am still confused as to why Cetelco would ask the above questions then suddenly not reply when I ask why?.

            I have been open and honest to all my posts stating that I have never done this section 75 before and asked for help and guidance for which I have followed Cetelco's advice on the matters and thanked them for this at each point. I am sure I didnt cause any upset to anyone along the way. So this is why I cannot understand the sudden silence now, because I would ask why a question was asked, and what if any difference it would make.

                There is no silence. There is however, a wearisome resignation that once again, advice is ignored and help is spurned.

                You need to act. That is to say, do what you wrote that you would in your LBA. If you are not prepared to do that, why did you write it and send it?

                You do not need answers to any questions, you need to act, or not, if that is your preference. This is a self-help site. Advice, opinion and help is offered but nobody can carry out any claims for you, that is something you must do for yourself.

                You purchased, using a credit card, a service that was not delivered. Therefore, under current, primary legislation, you have a like claim against your card issuer.

                I wrote what I did on page one of this thread in order to enlighten those who, for whatever reason, were not aware that if they purchased tickets for a holiday involving Goldtrail using a credit card, they were able to recover their money, in full, along with other costs and expenses associated with their purchase. Rather unsurprisingly, credit card issuers deliberately fail to mention this inconvenient truth to their customers.

                If you think what I have written is wrong, stop your claim. Alternatively, read and fully understand what is written here and on the other threads that are linked on previous pages and follow the advice that you have been given.

                  Thank you Cet for the reply. In reply I am and have so far followed all your advice and quite prepared to take the action I did threaten, but time scales have not been met quite yet. I have previously stated I know nothing about doing these types of things and without your help and guidance. I could not carry this through.

                  I did however still wish to know why you should ask about the way I purchased the flights I am claiming back on section.75. I do not think this is unreasonable of me to ask this, but I note still you did not answer that.

                  I would be very grateful if you would continue to guide me through this section.75 and any action that I need to take. If you feel you cannot for some reason then I would also like to hear this now. I would have to then consider going via Atol and there long drawn own process .As I really do need to reclaim this money back asap as previously stated so would obviously prefer the section 75 route with your help.

                    Regarding timescales, since Capital One have refused you a refund, you may issue your claim against them at once. There is no need to wait for the 14 days to expire.

                    You should now issue a claim against them, citing the consumer credit act.

                      Is this were i should go to lodge a claim please Welcome - HMCS Money Claim Online and complete claim against Capital One pursuant to section 75(1) of the Consumer Credit Act 1974.

                        Yes and yes, although personally I prefer to file using a paper N1 Claim form and visiting a court. If this is not convenient, then by all means use MCOL.
