  • Gym Membership and CoronaVirus (Mandatory Closure - Direct Debit)

    Good Morning.

    So the Government has announced mandatory closure of bars, clubs and gyms.

    TotalFitness has made no mention of the cancellation or freeze on direct debit payments. I have a law degree so am I right in presuming that the contract with them is frustrated or breach of contract?

    The contract provides the use of their gym facilities in return for £35 a month, but if their gym is unavailable then they have no consideration on their part anymore and legally I should not have to pay?
    Is this along the right lines? They have not mentioned payment freezes etc, what can I do/say?

    Have you called ( or messaged/emailed) and asked them their intentions with the gym membership ? I believe they are offering payment breaks so you can pick up the payments and contract once they reopen.
    Do you have an online account area via their website where you can manage payments etc ?*

      My local gym ... I expect most will be doing similar xx

        Check your terms and conditions and see if they have made provision for this type of situation. Usually it will be in the force majeure clause, but you can't rely on frustration if the contract has already covered the situation.*

        The Gym Group has also frozen payments too for the foreseeable.*
