  • Question about Consumer Contracts Regulations

    Good morning. I hope you can help with a question about a refund under the 14 day cooling off period.

    I purchased, over the telephone a weight loss course. The course contained online content and youtube videos. There was also telephone support. I paid £1000 -up front by credit card.

    After 7 days, I decied that the course really wasnt for me and that I wanted to cancel and receive a refund. I am happy to pay £100 for the week that I used.

    The company is refusing to give me a refund claiming that digital content falls outside of these regulations. The content is not downloadable, it's an online course.

    She has her own Ts and Cs which state a 7 day refund period but this does not include change of mind. are her own Ts and Cs able to supersede the consumer regulations?

    I really believe I am entitled to a refund. Am I correct?

    I purchased the course on 28th January and sent an email to cancel on 5th Februaty. Everything is documented.

    Can you give us the link to the terms and conditions or copy and paste them please - you should have been sent them by email or post when you placed your order.

    How does access to the online content work ? Is everything available in one go or is each week released to you at the relevant time in the course ?*

      Thanks for getting back to me.

      I wasn't sent the Ts&Cs either in the post or by email. There was a link to them in an email which takes you to a downloadable Google file - https://loseweightonceandforall.us6....c&e=69a1f0370d. I was never sent a hard copy.

      The content is released at the relevant time in the course. At the time I requested the cancellation Phase 2 had just been unlocked.

      I will have a read through of the links you have sent.

        There is additional info about the Ts and Cs but you don't get this until after you have logged in - no mention on this screen:

        Then, once you have logged in you get this message:

        Please Note:* As this program consists of**digital and downloadable content, *as soon as you log on you have access to view and download content. By entering this members site you are agreeing to the terms and conditions

        This may or may not have been there when I first accessed the page, unfortunately, I can't remember but if it was, I'd already logged in by that time.
