Very confused - our Small Claim was struck out today

So we have the application hearing tomorrow! Other side won't be attending as they don't work on Fridays. WTF? They've been excused.

Any general advice on relief from sanctions hearings? We are asking for a final hearing, and the previous strike out to be overturned.

We got the app in in plenty of time, so any advice would be great and appreciated. What're the important things to get across to the Judge!

So the case was reinstated. Very happy. We have three weeks to send new Particulars of Claim.

Interestingly, despite my stating we have screenshots of all bets which were cancelled, with unique bet IDs for each one, and the word 'CANCELLED' written right there next to each, Ladbrokes, who were not in attendance, submitted a draft Defence which states these were actually 'bets in progress' and were never placed.

We are no wondering the following: When we bet on Ladbrokes, a contract was formed every bet that was placed. You bet, the bet is accepted, and then the money taken from your balance and a unique bet ID generated.

Ladbrokes are at fault in this matter for cancelling these bets afterwards.

As they have done this, and continue to deny that the cancelled bets exist, is it possible to make the case that, as the contracts were voided by Ladbrokes and they broke their own rules regarding placing bets, we can now ask that ALL bets be cancelled and the funds bet returned.

As the account has a net negative loss of about 4K when you add up all winnings, minus deposits, we were thinking this was the way to go?

I take it there's really nothing at all in the terms and conditions that covers this situation?

Can I ask at what point these bets were cancelled? Did Ladbrokes cancel them just a few minutes after each was made and long before the race/game/event?

Presumably, if they had waited until you won and only then cancelled the bets, you'd be screaming blue murder the very first time it happened, and you'd have stopped betting with them?

Well, you really would be trying to cancel things long after the event, so I rate your chances at next to nothing. Nice try though.

So, generally, you have lost on your bets overall. So, why would these cancelled bets be different?​ You don't have to explain it to me, but you should be prepared to explain it to the judge.
