        With regards to ''Whenever I've complained to the OFT direct they respond with a 'we don't do individual consumer complaints' letter. So not had a great experience with them either.'' - No they don't do individual complaints but it only takes a few complaints for them to consider a formal investigation, so although it may not result in any conclusions for your specific case, it will be held on record.

          Do you have a genuine complaint against a DCA or Collections Department?
          Are they acting against OFT Debt Collection Gudelines?

                  Licence No: 348351

                  Thank you for your complaint and permission to disclose forms, received on 21 December 2008.

                  I am very sorry to hear about the difficulties you have been experiencing however, the OFT has no authority to become involved in individual disputes between consumers and traders so we cannot advise you directly in this matter.

                  I enclose a list of organisations which can offer you help and advice. For specialist, face-to-face assistance, or intervention, you may wish to seek legal advice either through a local Citizens' Advice Bureau or directly from a legal adviser.

                  I can confirm that the business you mention holds a consumer credit licence. Under the Consumer Credit Act, holders of consumer credit licences must be fit and competent to do so and the OFT has a duty to monitor the fitness and conduct of all traders who hold such a licence.

                  The OFT has issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance is intended to ensure that debt collectors treat individuals fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants.                     Excellent frisp my friend and thank you very much for being willing to use the official complaint form. This is proof that if you do complain they do listen. As they state in your reply from them, they cannot comment on individual cases, that is fair comment. At least if they receive enough complaints for different DCA's etc they are able to act. I would assume that every complaint is taken into consideration when companies apply to renew their consumer credit licenses.

                    Many, many thanks frisp, I hope this encourages lots more people to follow in your footsteps if they have a genuine complaint.

                      Update LGO have got back to me to say that they are beginning their investigation. More as it come in.

                      Glos TS are aware of this step and have written to tell me so

                          More updates with my ongoing TS battles.

                          The following is a complaint against Marlins as they have bought a an account under investigation by the FOS from HFC and I'm complaining that they have no rights in this matter.

                              I cannot believe that TS are even considering Rankine in this case as it has no bearing and also was a "bad" judgement.

                              I would write back to them and ask them exactly which part of Rankine they are referring to.
                              The fact that the agreement is at an end is irrelevant, IMO, as legal action would be taken in regards to this account.
                              So in at least one respect it is still active.
                              An agreement is never really terminated, otherwise enforcement action would be impossible.

                              I believe that they are confused with the default provisions under s87 onwards and s98 termination.

                              What was the loan from HFC for ?
