        hi thanks for the kick! no have not done anything regarding this yet as have been concentrating on getting my bank to look at my hardship case.

        I do feel that RH have done nothing to actually claim my bank charges lately and have stopped at the stay at court stage.

        If i am successful with my claim through my own actions ie writing to them and telephoning them constantly i will be very unhappy to hand over any cash to RH for doing bugger all.

        What do you think my way forward is regarding this?
        How can i complain about them when my case apparently is stayed by the court due to test case according to them.

        Also if i get refunded by the bank due to my own actions they will not find out and by the time they do i will just say that it was settled out of court and i will only pay them for work they have done. Also as it is no win no fee if all is lost via the test case i will owe them nothing so just going to sit this one out to be honest.

          Have you asked RH about the hardship status of your claim and why they aren't doing anything about it?

          If you do and get a reply, please let me know will be very interesting. I may ask them the question myself actually in response to an email i received from them today (in VIP if you want a look honey)

            Hi Jules,

            Ive used this company (Robertson Holbrook) and they are taking ages to progress my bank charges case too, every time I phone them they tell me the same story about The FSA waiver and the Court Stay which is really frustrating. Jules are they making that up as an excuse not to process my claim(if so can I sue them for costs?

            I explained about my baby arriving in August and RH immediatly started a hardship application which is being considered by the bank (Abbey) at the moment, although Abbey initially sent a letter suggesting I didnt qualify for Hardship RH sent me an application to sign and return to them for The Financial Ombudsman.

            I now know I could have done this myself but I am the type of person who starts things and never follows them up so I probably would have fallen at the first hurdle and accepted the "generic" letter from Abbey. So although I agree with Jules about RH's time in processing on balance they do not seem to have let me down as much as you.

            Can I now stop using them and carry on my claim myself ? They guarentee to get back all of my charges in return for the interest ! so how much in interest are they likely to make at 8% ? ..I need every penny I can get at the moment with the baby so if I cancelled them how much more could I make and can they claim money for the work that they've done so far ?

            I dont think I'm as brave as you Jules, keep up the good work your an inspiration !!

              hi and nice to know i am an inspiration! that has made my day.

              I am surprised they are doing the hardship route for you but that is great the only thing about that is that they will not take it to court for a hardship claim it would have to be settled out of court because of the stay situation. So dont know how they will claim their fees as prob wont get interest in an out of court settlement you have to take them to court to do that, and that is how they get their fees.
              regarding cancelling your contract with them I dont know how much they would charge you as depends how much work they have done for you so you would have to speak to them about it.

              Anyway like i said i know it sounds bad but dont know what the outcome is going to be regarding the test case so i rekon any compensation you can get now is good if RH can push for it. If the case comes good then RH can then take em to court for their fees.
              The only thing you need to worry bout is how are RH gonna get their fees if they settle out of court? You are aware also that if they do make you an offer this will only be a preliminary figure not a full and final settlement then it is just a waiting game on the test case.
              The other issue is would RH be happy to wait for their money re the outcome of the test case or would you have to settle with them if you get a settlement?

              Also to answer your question no i dont think they are making an excuse as cases are on hold but it is not really in their interests to do hardship route as they wont get their fees that way so i am a little bit confused bout that? (someone else may have an opinion on this)

              sounds like you are doing the right thing anyway and having a baby soon will mean you need all the money you can get so just keep plugging away.
