      I might be tempted just to let them try suing me for the money if they say they havent had the £320 - then they would have to prove you owed it and agreed it pay it etc.

      I suppose contract law wise you accepted when you sent them the details of each card etc.

        also that sounds like the bank charges fee and not the credit card claim fee. i dont have anything in writing about the fees charged for credit cards or store cards do you think they are different from the bank charges? as the credit card companies are paying up no problem without court or anything i believe it must be. if they are using the same pay structure as bank charges then they cant claim the court fees or anything where are they getting their fees from in this case. there is nothing in writing so therefore how can i be liable for it in the first place???

        what i am going to do is carry on with the claim myself and just let them stew for now. the only thing that i was contacting them for is update of exactly how much i am owed so far from the halifax up to jan 07 and wether this figure includes interest or not. but i can get this from halifax anyhow for £10 so if they cant find the postal orders then i will just leave em to it.

          If I were you, and this is just my opinion, I would do the credit card claims first, simply because there are no stays on credit card claims and they tend to be a bit easier to get back than bank charges anyway, and especially at the moment with the OFt and waiver and so on. This might be a quicker way of getting some cash back, especially if the charges outweigh the balances on the cards. I personally wouldn't bother telling them that you are making them redundant, so to speak, just do the claims yourself.You could always write to the banks, credit card companies etc withdrawing your authority for RH to act on your behalf, just don't tell RH as yet. Then they wouldn't be able to persue the claims for you anyway. And as for their fees, cross that bridge if and when it happens.

            thank you that is what i intend to do when i write to the credit card companies and banks i will state that i dont want RH to act for me anymore. Then if it comes to it RH will have to claim the money from me i will say i sent them a letter to cancel my contract with them and have a copy of the letter on my computer.

                ok found letters in library but how the hell do i know what the amount of penalty charges are over the course of my having the card? i dont have my statements from them or anything i know this is not very helpful. How can I calculate how much they owe me? without writing to them first?

                    yes RH have all the info but they are refusing to do anything till the £319 is paid they wont even tell me any information of where i am at with claims or anything.

                    so i may have to start again myself.
