An ex-customer is refusing to remove my products from their website, what can I do?

  • An ex-customer is refusing to remove my products from their website, what can I do?

    The menus, links and product details are still there but with a little note added underneath each image to say, “currently unavailable”.

    My products are quite "photogenic" so I can see why they might want to keep them there:

    Using my imagery to help their website.
    Driving traffic to their website.
    Making customers think the products no longer exist.
    Switching customers to competitor products (which they can offer).

    I have very politely (twice) requested the pages are removed, without success!

    Do you own any trade marks that the other party is using?

    Have you previously permitted use of your images? If so, can you withdraw that permission? What I am leading to here is whether you can demand removal of the images on grounds of copyright infringement.

      Briefly,

      I have never registered any trademarks.

      Most of the images they use are mine (I’d say 90%) but they have taken the odd pic themselves and I would have sent those over the years; so I’d say yes, the images “did” have my permission.

      The product listings on their website also have my business name on them.

        Identify exactly which are your images, and withdraw consent for their continued use. Say that continued use after a reasonable time will be copyright infringement.
