  • CCJ Set aside

    This seems to confuse

This is incorrect because Lowells or any other debt collection company cannot take you to court for a debt they bought. The only ones who can take you to court is the original creditor. Northampton business centre are not legal, they have no legal representatives or Judges and certainly no courts. You will never get any papers to defend yourself because if you defend yourself it will be thrown out of court because debt collectors cannot take you to court for a debt they bought or it could be thrown out if it statute barred so Northampton will not give you a chance to defend and then issue a CCJ and it will be registered but it is not signed by a Judge. If you told you have a CCJ and never had the original papers to defend or was statute barred at the time of the CCJ you must fight it and get it removed.

    So breaking it down....

Lowells or any other debt collection company cannot take you to court for a debt they bought
Yes they can, as by legal assignment of the agreement they have become the creditor and have all rights under the agreement.

. Northampton business centre are not legal, they have no legal representatives or Judges and certainly no courts.
NCCBC are not a court, they are a processing centre for, primarily online moneyclaims through the moneyclaim system. Once a claim has been defended it is sent over to the claimant or defendants local court for directions/hearings etc. They issue default judgments on a procedural basis if a defendant does not defend or acknowledge the claim. They do not assess the claim themselves.

You will never get any papers to defend yourself
When the claim is served it comes with a Response pack which includes the forms to acknowledge and defend the claim, and also gives you the details to sign up and log on to the electronic moneyclaim system to enter the same.

because if you defend yourself it will be thrown out of court because debt collectors cannot take you to court for a debt they bought or it could be thrown out if it statute barred so Northampton will not give you a chance to defend and then issue a CCJ and it will be registered but it is not signed by a Judge.
Not sure what that's saying but a) yes they can b) if its statute barred you would defend it as such c) you have chance to defend - 14 days to acknowledge firstly then extended to 28 to defend d) Default Judgment is only issued if you fail to acknowledge and/or defend the case - if you get a default judgment it is valid, and you CAN apply to set it aside if it was issued at a wrong address and you knew nothing about it.

If you told you have a CCJ and never had the original papers to defend or was statute barred at the time of the CCJ you must fight it and get it removed
oooo I agree with something.... yes - this is called a set-aside application - see Set Aside Application

Have you been watching weird freeman on the land type videos ? basic rule, ignore everything they say, they are wrong. Not clicking on any of these as they look well dodgy and likely to just cause viruses....

I have removed your very similar post on another thread. You seem to be quoting someone who has randomly commented on a Youtube video ... not the greatest source of reliable information or advice. Particularly on a video from someone who uses 'beat the bailiffs and the banks' 3 letter process utter tripe. Please don't repost it on others threads - it is wrong.
