  • Hi - my father is owed 40K

    Hi,

My father owns an engineering company. His turnover is 200K a year, and he has been owed 40K for six months by a very big company.

He is at his wits end chasing this company. He has asked me to enquire what he can do to hold this company responsible legally?

    Thank you,

    D

Start with the Late Payment of Commercial Debts Regulations 2013 he will need to send a new Invoice with the new figures on it - for 40k he's looking at an extra 5k. Time for sentiment has now passed and this is someone he can well do without. He should then think seriously about court action or has he heard anything about their situation.

He could look at filing a claim in the County Court, which initially would incur a fee of £2,025 (4.5% of £45K) and before doing that he should send a letter before action.

He could do this himself, however he might want to engage a solicitor to handle it for him.
