    Hi All
    I am wondering if anyone can tell me how long roughly it takes for ATOS after assessment to do report and send to DWP?

    I had my assessment on 29th JAN and DWP got report on 2 FEB. To be truthful I think they have mixed my report up with some one elses as on the decision makers reasoning it was all about making budgeting decisions, reading signs, planning and following routes etc which they said i said i had difficulty with, and all the problems i do have difficulty with they said i said i can manage!!!!! All my problems are around personal care, I have requested a copy of ATOS report to see what has been said but i just thought that DWP recieved the report within 2 working days was rather quick

    Impossibly quick I'd say.
    My son's report took over three weeks
    This is from Atos website: " O
    nce the healthcare professional has all the necessary information the face-to-face interview ends. The healthcare professional will then take some time evaluating the information obtained, suggesting the most appropriate “descriptors” and writing a justification of their choices, to complete the report for the DWP""
    Unlikely in two days I'd have thought, but await your copy of the report just in case!

      Thank you for your reply Des8. Thats what i thought, It seems that I have been mixed up with someone else as all the reasoning is wrong, unless they have just make it up!!
      I am phoning them today to make sure this report has been sent out and i have an appointment with welfare rights tomorrow to get help with the reconsideration letter
      I am quite curious now to see what the report says, will post again when i get it

          Hi again
          So never received report from DWP so phoned on 21st feb to see if been sent out, girl said it had been posted out on 19th feb, great i thought, i can still get to see whats on it and challenge what rubbish they have put before i put in my mandatory reconsideration letter. anyway this report never turned up so had to send in my reconsideration letter without it :tinysmile_hmm_t2: but my doctor wrote on my behalf saying that after examining me he felt that the descriptors i was challenging were consistent with my problems
          I phoned DWP this morning to ask about my report and lady said that it has NEVER been sent out!!!! Why are they lying??
          I also said about the 2 days from medical to them receiving report being quick and she admitted that it was a bit quick but clamped up when i said i think they have mixed up reports, it just makes me all the more convinced that the health proffession has made a mistake and mixed reports up.
          Anyway feels good to let off some steam and will post again as soon as i hear anything

              Heard so many delays with ATOS appeal decisions.

              If this helps with your question:

              My ATOS appt was Thu 28th Aug 2014 and as I had claimed bus travel expenses (times are hard when solely relying on JSA payments so every little bit helps), the travel reimbursement cheque arrived on the Thu 11 Sep 2014.

              I couldn't get to the bank that day, so on Fri 12 Sep 2014, after I gave the cashier the cheque, I got a mini statement from the ATM and saw that they had agreed with my doctor and awarded me ESA on Thu 11 Sep 2014.

              The DWP confirmation letter arrived shortly after and was dated Mon 8 Sep 2014.

              So it was 14 days from the appt to the backdated money to be deposited and 11 days for the decision.

              Keep at it though because I have two peeps who have appealed and won. One placed an appeal twice. I didn't know could appeal on an appeal decision but there you go!!!

                Wow thats brill news about your ESA, good for you hun

                Ok it seems that DWP dont know what they are doing, as i said i phoned them this morning to see about report being sent out... told no it hadnt been sent... low and behold whats on my door step when i come home?? Yes the ATOS report!!!

                Now in my original post i said the DM stated i said i had problems with reading and understanding signs, making budgeting decisions, planning and following routes well the ATOS report clearly says i have no problems with these activities so god knows where they got that from, however the ATOS report states that i could not put my arms behind my back or to neck level during the examination but then proceeds to say i dont need help with washing my hair and my upper half!!!
                it also reported that i couldnt bend my back to below knee level but then said i could dress my lower half!!!
                My grip in my hands is 30% to what it should be and cant lift pots or heavy items but because i had a handbag with me at the assessment and i pulled a open door further open to leave, my grip was normal and had no difficulties in preparing a meal which i have to say is very painful due to arthritis in every little joint in my fingers and thumbs..they proceed to say that due to

                "the chronic nature of her conditions, it is reasonable to say that she may become more functionally restricted in the short term"
                so to me they are saying i have restrictions in my joints already but not enough to warrant a claim!!
                Well i will see what the outcome of the reconsideration letter is but have a feeling it will go to appeal

                  Go for it if it does but you never know you may not need to!

                  Was preparing for mine but seems I wore her down and as you know she agreed with my doctor.

                  Mine went on for nearly 1hr 15mins. Know this because I asked for it to be recorded (heard they tell lies so prepared ahead) and because first side had run out, she turn the tape with a sigh and looked at the clock!

                  And no, never have listened back to it but requested it just in case I had to appeal!

                  As said, I know someone who appealed on the appeal! :colbert:

                  So first appeal was rejected and she won on the second appeal.

                    Hi again guys,
                    Just a quick update
                    Well I recieved my MR letter yesterday 14th march and was declined so onwards to appeal :tinysmile_cry_t: still only 4 points. Decision maker has said that the HCP is some one who is a trained disability analysis and gave their assessment of my functional ability based on their knowledge of my medical conditions..... errr hello you might have some knowledge but it is my body and i know what my body can and cannot do. Ok so they said i cannot put arms behind back or raise above neck level but could use a long handled brush to wash my back, ermmm only problem with that is cant get arms around far enough to use a brush and also using a up and down motion to scrub my back would cause pain in my shoulders (arthritis) so thats a no no and also to wear loose clothing, err I still need help to get over head or arms into sleeves unless of course the shirt was 20 sizes too big
                    Said I had no loss of grip or power in my hands as i had a handbag with me (keys,purse(empty btw lol) and painkillers) and that i drove a car. Now i dont know anyone who grips a steering wheel when driving, yes hold and guide the wheel (power steering)

                    I will be phoning Occupational health tomorrow to get another appointment for tests on grip etc etc as one I had before will be out of date for them.
                    When i get this report done and give to tribunal will they take this as true or still go with the HCP report. and if they go with DWP would this be classed as a error of law?

                      In 2013 43% of ESA appeals to tribunal were won by the claimant

                      Good luck with your appeal.

                        I will certainly have a look in a moment, I do have a welfare rights officer now who done my MR for me and certainly will represent me at the appeal.
                        I just find the whole thing a shambles, They are basically saying im not entitled cos i drive a car, this is referred to quite often in my ATOS assessment papers... grrr just makes me mad

                            Hi again guys
                            Hope you are all well. I just thought i would update as to where i am at and to ask a question also
                            I have sent off appeal request now and had letter back saying that they will be arranging time and place etc.

                            I have OT appointment on monday to be reassessed on my abilities as to what I can and cant do and will get a report of this to send to the tribunal. Shouldn't be any concerns there.

                            What i did want to know is will a letter from my daughter help?
                            She wrote a letter for the Judge stating what help she gives me physically regards to washing my upper body, hair and dressing etc etc, I was in tears after i read it, it was very honest and straight from the heart.
                            I dont know if this helps as its from my daughter or will they dismiss it as being bias?

                            Any thoughts would be appriciated
