endoscopy mishap

Hi , earlier this year I was rushed into hospital with panritis due to gall stones causing problems. I was in a week before they said they would remove my gall bladder once they had flushed the stones. I had a scan and they then said they would do endosopy to see where stones where ect. they said they might try and flush them , and I had had a endosopy a few month earlier awake just numbing throat spary witch I found very distressing so I was offered to be put to sleep .

I was put to sleep and had the endosopy . when I came round I was very sick but thought this was normal then after being in hospital nearly 3 weeks the next day they said I could go home for the weekend. I was over the moon even though I still felt quite groggy I went . this was the fri tea time.

on the saterday I was being ick every hour and became very wek not being able to even go to bathroom without help to be sick. my son and partner where veery concerned at my deteriation and amount of sick , they suggested going back to the hospital but I collapsed and they rang ambulance.

I was rushed into resusatation room where they said I had internal bleeding and was very ill loosing a lot of blood I had a 4 unit blood transfusion and was very ill. another 2 week stay in hospital

I was told that when they done endosopy that they may have cut me by accident on top of my bowel

just wondered if anyone can advise a no win no fee solicitor that I can put a claim in for me as I firmly believe this was avoidable and was caused by a medical mistake . sorry its a long post but I have condensed it as best I can

Have you made a complaint to the hospital?

What outcome do you want? An apology, an investigation, or just financial compensation?

Well to be honest I nearly died so a investigation would be a start and since I was off work over 2 month and was very I'll losing 4pints of blood I feel financial compensation would be justified

I have a complaint currently underway with my hospital through PALS, if you search your hospital and get there web page there will be a link. You can do it by email and they will reply either by phone or in writing within a day or so, usually it takes 28 days to get an answer although they may extend this if they need to consult, I would recommend you did this before consulting a solicitor, a it 8s the first thing they will ask you.

PALS is fine if in England.

The starting point in Wales is normally the Community Health Council, where patient advocacy services are available.

Also note that making a complaint is different from making a clinical negligence claim. A complaint should get you an explanation of what possibly went wrong, an apology and changes in practice to prevent similar happening again. A clinical negligence claim is for compensation.

Although Conditional Fee Agreements (no win no fee) are available do be aware that certain costs will probably have to be paid for as the case progresses and reimbursement may not be made until the case ends.

The Law Society and Action Against Medical Accidents (AvMA) have a referral panel of solicitors who specialise in clinical negligence and who are accredited by them.

you need that specialist advice. After you have heard what the hospital has to say.

The fact that you suffered a complication of the procedure does not mean there was negligence.

Piercing or tearing an organ is a known risk of endoscopy, it should have been on the consent form you signed and the risk explained to you.
