I have been suffering from severe disk prolapse on my back due to medical negligence by GP since last year (Feb 2013).
I recovered to the point where I could read, eat and toiletting by myself later.
And also, my savings were nearly dried up. I therefore applied for PIP in Oct 2013 after DWP advised me that my case falls into PIP.
The DWP said it would take maximum 6 - 8 weeks to arrange final assessment on my condition.
The assessment was scheduled by ATOS.
I received no arrangement dates after 8 weeks, so I regularly contacted ATOS to see the booking situation for my assessment. ATOS explained that the current government mis-calculated the number of applicants, so that the arrangement has been delayed.
Finally, I received pre-assessment document from ATOS today.
It is after 7 months wait.
My condition now improved to the point where I may be able to resume working under restricted condition.
My question is:
would I be able to claim the benefits I could ve received months ago if I use any legal teams?
I have borrowed money from my friends. I obviously have to repay now.
I have been inquiring medical negligence claims against this GP to some law firms which rejects my inquiry as they can not find merits in claims for causation although they acknowledge there was medical negligence.
It would be grateful if anyone could advise me on this issue.
