  • reclaming back crisis loan from 1994 to 1996

    i have been helping my brother with his claim of JSA, housing benefit etc.

    today I GET A DEMAND FROM THE DWP for three outstanding crisis loans from 1994 and 1996. i am not kidding on those dates.

    i agree i did take out some loans back then as i was homeless and no fixed abode but i require confirmation on these loans such as my signature etc.

    i asked them to send me copies of the loan application, my signature etc but they said they would not have this information anymore.

    as these are loans and not tax, the statute of limitations now apply so they cannot be enforced through the courts but the lady on the phone stated that the money can be reclaimed by either

    1/ if i made a claim for any benefit then they can deduct an amount at source
    2/ they can make a deduction when i start claiming my pension

    what are my options??

    can they take the alleged amount outstanding from any future benefit award and what about the DWP not having any documents to substantiate their claim money is outstanding

    we are talking nearly 20 years ago

    Ask her how much is allegedly owed, the dates it is owed from and then ask, if they do not have this information anymore then how do they know its owed and how do they know how much is owed?

    If they do not have the documentation you do not owe it.

    See a solicitor that specialises in benefits etc.

      They tried the same with me - Out of the blue in june this year i had a letter demanding i repay a debt for a social crisis loan, which i can only assume to one of the 2-3 i had back in 2007-8 whilst out of work and prior to starting my company (wow how my furtunes has changed since then lol). So what i did is i sent the letter i have PM'd you, to them, and i haven't heard a thing since!

      Reason i PM'd is is because i can't be arsed editing all my details and militant knows who i am anyway.

            bit of development on this matter

            just had a lady from the social fund phone me, she has stated that they will be taking out payments of £6.00 per week from my army pension (medical discharge)

            i told them i am still awaiting copies of my signature etc on these social fund loans to confirm i did take them out and that for them to take money out of my pension prior to them assertaining the debt belongs to me is misrepresentation and poss theft under the fraud act

            she stated they did not have to supply this information before they start deductions

            remember these alleged loans are from 20 years ago

            some pointers from posters will help as benefits are not my area of expertise
