  • Housing Issue with Council.

    Hi I am hoping someone can help me please.

    I have been renting a property form a private individual and paying the rent weekly until I put in a claim for Housing Benefit, I then had the Housing officer turn up to tell me that the landlord does not have permission to let the property and he wants me to vacate.

    Please can anyone tell me what my rights are, my son and me are devastated by this and the Council would like me out in 1 months time.

    They have served notice on the landlord, well they hand delivered it but they know he doesnt actually live here..

    What are my rights please.

    You should contact Shelter or a Law Centre, www.lawcentres.org.uk

    If it is a Council property, your landlord may be sub-letting to you illegally and the council may be permitted to give you notice. It is hard to think of any other situation where this would be the case.

    However, you are now at risk of homelessness and the council have a duty to give you advice ! This will probably be a different department. If your son is under 18, you may be in priority need and the council will have a duty to house you. Shelter should eb able to give you more advice.

      Dont they also have to serve paperwork on me? Whats the process for evicting me then?
