  • Non dependent disregard

Friend in receipt of guaranteed pension credit has been receiving full housing benefit. Family member temporarily moved in with her following divorce until financial remedy sorted. After 6 month disregard ended Family member went to temporarily live elsewhere. If their new accommodation doesn't work out & they move back in with friend, would a further non dependant disregard come into play

When a pensioner over 65 has a resident non-dependent then any change that would affect the housing benefit is disregarded for 26 weeks by way of a non-dependent deduction delay. These changes can be someone moving in, the non-dependent income increasing etc For every change that would adversely affect the pensioner, a non-dependent deduction is applied. However this always ends after 26 weeks, resulting in a non-dependent deduction commensurate with the non-dependent's circumstances at the time. I see no reason why the non-dependent moving back in would be treated any differently
