PIP: Do decision makers often overrule assessment report?

Hi :-)

I am asking on behalf of my Mum.

She had a Pip assessment on October 15th, she rang up and asked for a copy of her assessment report a few weeks back. The assessment report has sadly mis-represented a lot of information and has suggested 0 points on every descriptor.

I am just wondering if it is possible for the DWP decision maker to overrule the assessors suggestions? Or is that extremely unlikely?

Possible, but unlikely as until a request for a mandatory reconsideration is received the DM has only the assessors report

There is only a limited time in which to request a mandatory reconsideration, and if that fails there remains an appeal to the tribunal.
Although you can request mandatory reconsideration by phone IMO it is better to use their paper form (https://www.gov.uk/government/public...d-pensions-dwp)

Knowing that over half of appeals are successful is very encouraging.

It makes me wonder how that happens, that the initial assessor scores 0 points, but at the tribunal stage it's decided differently, because the facts remain the same.

My sister went through the merry go round of PIP assessment then saying no, having the sign on for work she cannot do then reapplying for PIP being told no etc etc. She went to Citizen's Advice with medical records, and with as much evidence as possible. It never made it to tribunal before the decision was overturned. Many of those carrying out the assessment are unqualified to do so. They hire nurses, physiotherapists and that is for assessment of complex conditions that they may not have specialisation in.

Here is a recent statistic in relation to social security and child support cases that went to tribunal. There is a 67% chance of it being overturned. That's only on cases which reach that stage.
