  • Debenhams Store Card - Santander - Rejected

    Dear All,

    I am hoping someone could assist my wife here with her rejected Santander for a Debenhams Store card.

    Herself and her mother, where in the store at the same time and both took out a newly offered card at the same time, and spent near the same amount and never again used it since, All they needed was some wedding stuff at the time., Now a month ago or so Santander got intouch with her mother out of the blue and said "hey we owe you some money" and she got £2500.

    The wife wrote off to them, and i think they have just fobbed her off,

    It would be fantastic if anyone can let me know if we can turn this around and put it back in our favour..

    I feel she is being mistreated and fobbed off with a standard letter

      Send this Santander Final Response with a new cover letter to Genworth Financial, Building 6, Chiswick Park, 566 Chiswick High Road, London W4 5HR.
      It is very important that
      1. You state any medical condition at the time of sale, you state what it was - even if common ailments like back pain, arthritis, high blood pressure etc. - anything that is verifiable on medical records.
      2. You state any good levels of sick pay (more than 6 months).
      3. You state any savings or other means of paying had you been sick or made redundant
      4. If you were self employed.

      These elements are necessary for a non-advised assessment. Other stuff will also be looked at such as the value for money of the PPI and whether you signed separately for it - but you would not know what this was unless you have a copy of the agreement. Genworth will know.

      Not all Santander store cards (ex GE Capital Bank) get upheld and you are unfortunately in a period where the value for money argument will not be enough on its own to win. So you really need one of the 4 elements listed above. If you do win, PPI paid of around £200 in 1999 will produce redress of around £600 including account & statutory interest.

      If Genworth do not uphold your case then go to FOS - especially if you have one of the listed items above. Very high chance you will win.

        are there any wrong answers to give.

        As far as i am aware,

        She does have back pain,

        2. You state any good levels of sick pay (more than 6 months).
        Dont think she was working at the time

        3. You state any savings or other means of paying had you been sick or made redundant
        Yes she had good savings and a well paid job with a partner at the time

        4. If you were self employed.
        No she was not


        Would my answers there be benficial towards our case >?

          OK - you have 3 points of very high merit to support a claim for a non-advised mis-sale.

          Make sure that these 3 points go in your covering letter with the Santander Response - or complete the FOS Consumer Questionnaire with these 3 points made clear.

          1. Back Pain - will help if recorded in medical records or had time off work due to this (but not essential).
          2. Not working at time of sale.
          3. Good savings - state what they were - how much and what they were e.g. £3000 in a Halifax savings account.

          It is highly unlikely that Genworth will defend this as they know it will lose at FOS. Any one of the above is good enough to win but all 3 together are overwhelming!

          Go for it - let me know if you do not get an offer in the first instance and need more help.
          If by some strange quirk they do defend this case, we definitely go to FOS because the 3 points above are all very strong indicators for a FOS uphold.
