    Hi Guys,

    I have been asked by my parents to handle looking into if they had PPI missold. My parent's knew nothing about PPI before all this scandal, so I would imagine most of them (if they did have PPI) would have been done without being explained. The only issue is, we don't have the T&C's only a list of loan accounts/credit cards they have had that MAY have had PPI on them (not dates, just account numbers).

    My question is, can I just write a speculative letter to each lender asking if they have had PPI on that account, and if it does then stating that it was missold as it wasn't explained to them at the time/pointed out/automatically enrolled?

    Any advice would be extremely helpful, as I am at a bit of a loss on how to proceed. Also keep up the good work guys! :tinysmile_grin_t:

    What's the status of the accounts? Are they still live and up-to-date? Defaulted? Closed with no outstanding balance?

    They could send CCA requests for copies of the credit agreements applicable to those accounts but that only applies where there is an amount outstanding (live or defaulted accounts); there is no duty to respond if the account has been closed with a zero balance. The idea would be to see if the PPI box had been ticked and/or if there was any mention of it anywhere in the paperwork.

    It may also be an idea to send a SAR to get copies of all statements, for credit cards the PPI would be stated as such on the statements. A SAR is a request for all data held about a subject and is person specific rather than account specific. If there were two or more accounts with the same bank they would be covered by one SAR, which is just as well as it would cost them £10 a pop + recorded delivery postage. Unlike CCA requests, they still have to respond to a SAR even if the account has a zero balance, however, most banks will only provide statements for the past six years.

      As long as you have the Full Name and all previous addresses the name of the creditor (s) and dates relating to opening and / or closing an account it should be possible to get all the " personal" data a creditor holds on all accounts it holds on an individual.#

      A SAR- Subject Access Request made under the Data Protection Act 1998 should be addressed to the Data Controller of each creditor. There is a £10 statutory fee to pay for each SAR, one fee covers all accounts on may have with each creditor they 40 calendar days to comply.

        The lenders have been made to improve their PPI handling processes and there is no longer any need to routinely put in SARs. In the first instance just contact the lenders direct and ask about PPI - the major lenders have special PPI helplines listed here http://www.financial-ombudsman.org.uk/contact/PPI.html.

        If you don't get a reply or you think it may be incomplete, at that point go through the bother / expense / delay of a SAR.
