  • Trying to reclaim from Renault Financial Services (RFS) but I think they're lying!

    Firstly, I am so sorry for this long post.

    I first tried to claim my PPI back in 2012 for protection against a car loan I had in 2001.

    1. I didn't have any details of the loan, just the car Vehicle Registration Documents, which I copied and sent to RCI (as it's now known), they couldn't find my policy and told me to write to Lloyds Banking Group Archives, who hold their old accounts.

    2. Lloyds reply that they don't hold any customer or policy information and that I should contact RCI again.

    3. I write to RCI with as much detail as I can AGAIN and this time I am sent a copy of my terms and conditions and an agreement number! However, pages are missing and they've told me they have no record of the PPI I took out.

    4. I ring RCI directly, lovely as the lady was, she is no help and says that the only thing I can do is supply them with old bank statements with the charges on them.

    5. I go in to Barclays, as my old current account was with The Woolwich, they have no record of me.

    6. I try to search for old accounts in my name online, nothing.

    7. I find Legal Beagles *YAY* and read something about a SARS, I write to Barclays...they send me the old Woolwich account statements, but no sign of the PPI!

    8. I write to NatWest (SARS) AND THIS TIME I HAVE THE PROOF! There are three years worth of monthly payments to RFS CREDITGARD.

    9. I fill in and sign a copy of the Financial Ombudsman Services' questionnaire. Include copies of all my paperwork and send the form by recorded delivery to RCI.

    10. I receive a letter to say they can do nothing without a copy of my finance agreement. I WANT TO CRY!

    So, Legal Beagles...do I NEED this? If I do, where can I get it from?

    Hi,

    I am in much the same position with Black Horse at the minute.

    So here are a few suggestions. Find out who the MD of RCI is, likely information available from the net or if no help there, find out by calling them directly. Write to him/ her via e mail. Ask if they actually hold the agreementpapers, from that date, or if they have destroyed them. In other words whyif you have supplied dates and payments for loans they want a copy agreement? Managing Directors usually have staff working for them who will get back to you fairly quickly. They may have a copy of the agreement filed under agreement number, which they may tell you it is too difficult to find, or they may not have a copy of any agreements dating back that far. They are not required to hold information longer than 6 years after the agreement finishes. In fact most of them do. In theory, if they have the information they should supply you with it. You can always take further advice from the Information Commissioners Office; although I have found that the information that is supplied on the phone is very helpful but ask them to confirm in writing and it is less so.

    if they have copy agreements but refuse to look them out, you can of course go to FOS but at this stage you are only asking them to rule on the availability of the agreement, not on the validity of your claim. However, it will also do no harm to phone the Ombudsman. You will have come across varying reports on the Ombudsman but I have had no difficulties to date and have found them very helpful.

    finally, you will have to make a decision on how to proceed.

    I am currently taking Black Horse to the small claims court. There is a lot of very useful and east to understand info on the net. The fee is relatively small compared to the claim. If I lose, I am down a small amount of money but am really no worse off than I was. It will also cost Black Horse more than it is costing me. I have a rough idea of how much I borrowed and can therefore take a rough guess at how much would be owed in PPI monies. I am prepared to take what I consider is a small risk. If there is no movement on settlement my case will be in court about spring. I have been working on this PPI recovery for circa 15 months to date. So it is about perseverance and tenacity!!!!!!
