  • Santander 3 Loans, one with PPI, how do I proceed?

    Hi guys/girls,

    I have just had my SAR back from Santander, which shows over the years, 3 loans and my mortgage.

    The first loan I took had no PPI, the second one DID have PPI and the third didn't.

    My question is how to proceed with asking for a refund now.

    My employment status during the period off three loans was the same, full time employed and full sick pay 12 months and then 1/2 pay for 12 months.
    I also remember the chat with the agent on the phone going along the lines of "It's your second loan with us so it's more likely to be accepted with the insurance"
    The third loan I spoke to someone in work about it and he advised me at the time we didn't need the PPI because our sick pay was enough to cover it.

    I have just had a letter back from MBNA saying they are paying me £2200 back from my claim with them, and EGG are dragging their heals....

    Can anyone help with the best way to proceed with Santander please??

    Hi there

    Go to Santander website and check out their complaining procedures, even thought its generally the usual complaint questionnaire form, you basically need to get the complaint form completed and confirm you already had cover with your employer and any other reason you believe it was mis sold to you.
    I will say in advance though Santander are not the easiest but do stand your ground and do not give in.

    You will also see in this forum many who have had dealings with this bank, so check them out, and also the thread called "Your own experience with Santander" could be worth checking it out - in order to take some useful tips from it and to ensure the bank follow the guidelines correctly.

      Hi Di,

      I'd read through that thread and drafted a pretty comprehensive letter along with the usual claim form.

      I just need to see what I can do with EGG now, they've turned me down on my credit card, but I did a SAR and it shows I had it on a loan as well.
      I am going to fight them on both, the credit card was online, and I seem to remember that I couldn't proceed unless a box was ticked for the insurance. Not sure how to proceed yet, need to get my thinking cap on!

        What year was the EGG finance taken out?
        What reasons did they reject?

          The best advice about Santander - keep firm with them.

          I saw your post on our Santander thread and replied there.

              I got my reply from Santander, and it's another SUCCESS!!! I'm guessing my letter had the correct content in it. I'm accepting the £2569 they are offering!

              Onwards with EGG now......

                  I have been looking at my agreement with you, reference above and have noted that I purchased Payment Protection Insurance from you.
                  I am now of the belief that I was mis-sold this policy due to the fact that I was advised to take the policy as it was my second loan with Abbey, and it would increase the likelihood of acceptance again.
                  There was no advice given on what the policy actually covered, and wasn’t asked if my sick pay covered me (Which it would have done) I wasn't asked if I had the ability to continue making payments if I was off work sick or made redundant.
                  I solely took the policy because I was advised it would give me a better chance of being accepted a second time.
                  The main issues I have are, not being given the correct information when the policy was sold to me:
                  · It was stated / implied that taking out the policy would assist in my application for credit.
                  · Your agent did not provide me with the full information as to what the policy would and would not cover.
                  What I expect from you is justification that the policy was suitable for me based on my circumstances and an explanation as to how your suitability criteria works. If you cannot justify this to my satisfaction I request a full refund of all premiums paid to date as well as interest on these payments.
                  I would also like to highlight certain criteria from the FCA in regard to dealing with my complaint:-
                  · The FCA Guidelines are for both advised and non advised sales, before and after 2005.
                  · The information for PPI insurance has to be given before sale is completed for non advised sales, not post sale relying on the policy document sent later by post as an excuse to avoid responsibility.
                  · The company should not reject a complaint on the basis that the policy was not cancelled.
                  · The company should not assume that by signing the document a customer agreed to take the policy.
                  As I believe I have been deprived of this money I also expect an interest element to be added to each sum, at a suitable rate and using a suitable calculation method, as a compensatory gesture.
                  I expect a swift response to this letter within 14 days, containing either your full justification or notice that you will be refunding these payments.
                  If I do not receive a satisfactory response I will issue another letter notifying you of my intention to take further action if the matter is not resolved within a further 14 days. After this limit has passed I will be either contacting the Financial Ombudsman to investigate my complaint or issuing court proceedings.
