    Hi,

    I've never used a forum before but here goes...

    My ex-husband and I are trying to make two claims for mis-sold PPI. We held 2 mortgages with the Halifax and although we were able to provide pretty accurate details of dates taken out and addresses etc. the Halifax have written back to say that as we don't have the account numbers they are unable to take the claim any further. (Mortgages were relatively recent... within the last 10-12 years).

    Can anyone tell me if this is just a fob-off or if in fact this is the end of the line for our claim? I have looked through my Experian report to see if any mortgage information remains on record but unfortunately it doesn't.

    What's particularly frustrating is that we banked with them for many years and serviced the mortgage with the bank account so I find it hard to believe we've completely sunk without trace?

    Any advice in this instance would be gratefully received.

    Hi Beetle72,

    have you written to the Halifax using a "subject access request?" This will cost you £10.00 and it is encumbant on the company to send you details of business that you had with them. That is, providing they still have records of it. Companies must keep records for six years after the business has been completed but very few start destroying records after 6 years and one day. Please find below some wording that you can use as a guide.
    Start
    Please supply me with all data that you hold on me. This includes in particular, but is not limited to, the following:-




    1. The original signed, executed credit agreement/s and any terms and conditions that applied to the account/s at the time the account/s was/were opened.




    2. Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or otherevidence of that manual intervention in relation to my account.




    3. Documents relating to any insurance added to the account/s, including the insurance contract and terms and conditions.




    5. Details of all charges added to the account/s; specifically, the date they were/it was levied, the amount of the charge, a detailed financial breakdown of how the charge was/charges were calculated, and what the charge covers/charges cover.




    6. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998.




    7. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed.




    9. Copies of statements for the entire duration of the credit agreement/s.


    10. If there is any information that you are unable to provide, may I have your assurance that this is because these documents have been destroyed.


    I enclose the statutory maximum fee of £10 and await the requested information within, but no later than, 40 days.
