  • EGG PPI. Claim rejected because I applied online. Help...

    Hi guys,

    I recently put a complaint into EGG using the standard form, and supplied one old statement. They have written back and said because it was an online application I was given the opportunity to decide for myself if it was suitable for me, and then given the chance to cancel it at any time.

    My argument was the fact that I had spoken to an advisor who said to go online to apply as it's quick and an instant decision and that it was more likely to be approved if I took it out.

    I did also take an EGG loan out over the phone and took the insurance on that too, but I don't have any records of the loan, how can I get the details??

    Do I have a case for the online one?
    Just for info, I was in full time employment with sick pay 6 months full pay, 12 months 1/2 pay and then statutory sick pay. And also had other means of paying off any debts I had.

    In lots of these online applications, the PPI acceptance box was pre-ticked, do you know if this was the case with yours??
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      Hi,

      I'm not sure to be honest, it was 14 years ago. I'm guessing I won't be able to find out? I know on my MBNA credit card form it was pre ticked!

        Sounds like an SAR may be in order. This is Egg's/BC's latest ruse with online ppi claims to avoid paying them.

          Is this something that they can get away with then? What will a SAR show me though?
          Would the SAR also show my egg loan as it was at a similar time and the same address?

            Depending how you phrase it, it can potentially show you ALL the information they hold about you. This would give details of the account for which you've mislaid details and all information regarding that and any other accounts held with them. It should also give you copies of the original agreements.

                Hi Trackmaxi, Fed_up,

                The extract below is from a letter I have sent to the CEO of some companies. It applies to online applications. I haven't lost any cases with it although one is with FOS.

                Start....
                I would ask you to review my case in light of the concerns below.

                The regulator has issued guidance as follows which suggests that a firm should not consider, solely, "a tick in a box".


                DISP App 3.3.5 FCA


                The firm should not reject a complainant's account of events solely on the basis that the complainant signed documentation relevant to the purchase of the policy.


                Please explain to me how you have taken account of this rule, and indeed the other Disp rules, when assessing my complaint.


                In addition I have enclosed a SAR ( with the appropriate fee) and, would ask you to let me have a copy of all correspondence and documentation as requested therein. This includes the original application form with all the terms and conditions as detailed in 2001.


                The regulator has stated that when a company offers a product for sale on an "information only" basis, it must offer enough information and detail to ensure that the customer can make an "informed decision" before purchase of that product. I do not believe that such information was made available to me before this product (PPI) was purchased.


                To reiterate my concerns.


                1. Charging; there are in fact several aspects to this. It does not cost £xxx amount per hundred as indicated on literature. This is only the initial aspect of the cost. The monthly PPI premium, when added to the ongoing balance of the card (which incurred interest in excess of 20%), increases substantially.


                Additionally, supported by the Office of Fair Trading's April 2006 statement into credit card charges, which noted that the level of charges at the time and, prior to that period were unfair, Xxxxxxxx PPI premiums were added to my account, where charges (for late payments and going over the credit limit) well in excess of the recommended £12.00, had been applied. Again, substantially increasing the cost.


                So, as per my initial complaint, please explain to me how the information that xxxxxxxxxx provided when I took the PPI out, made these facts clear and, as such, would have put me in a position where I was able to make an informed decision.


                2. Cancellation of PPI; while I understand that cancellation of the entire contract was possible within a 30 day cooling off period, I was unaware that the PPI could be cancelled at any time. (At least that appears to have been the case from information that I have been able to access on the internet).


                So, as per my initial complaint, please explain to me how the information that Xxxxxxx provided when I took the PPI out, made these facts clear and, as such, would have put me in a position where I was able to make an informed decision.

                  Hi, Thanks for that! I have amended that a bit to suit my line of a complaint and included a SAR with my payment.

                  I will keep the post updated with the response I get. I am still waiting for MBNA to fob me off now....

                    Quick update........... Egg ignored the letter I included to them saying I wasn't accepting that it was my fault and I am now waiting for my SAR from them.
                    I have had success with MBNA though, no quibbles, looked at my account and letter, and refunded me £2200. Amazed isn't the word! £1300 of that is interest!!
