Re: claiming back ppi from debenhams store card that was taken out pre 2004
Hi there
At first write to Santander, details of these below for you to follow on the link, as these deal with Debenham complaints, they should have a complaints form for you to complete with your reasons on why you want to complain etc, give them all the info you can remember.
http://www.santander.co.uk/uk/help-support/complaints
Do you have any old statements? if so the account number details should be enclosed, or if you paid directly from your bank account any old statements should show the account no next to the repayments you made.
Failing that for the one off payment of £10 cheque or postal order ( I suggest cheque) this way you will know its been cashed in, you can send a Subject Access Request (SAR) letter to request for all your info on the account by giving them your full name, address, date of birth etc in order for them to track down your account.
I shall post the SAR template letter below post for you if you wish to do this.
Now just to say they are not easy for everyone, but do not give up with them, if they reject your complaint then write again to give them a chance to review with any further info and why you disagree with the rejection, if that fails then go to the Manager.
Finally if there is no way to go with them, you have that chance with the underwriter but do ask them details of your underwriter for the account as it may differ to someone elses ,once you have those details let me know for the letter to use/tweak to your requirements etc.
There is another thread on here "your own experience of Santander" check that out because our Victoria and Liverpool has some brill advice on there to use, maybe check anyway before you make that complaint to Santander as they have guidelines to follow where they have been failing o use them, very much worth you taking a look as it may help you on your complaint.
My next post will be a SAR letter template if you wish to request for your details of the account, they have up to 40 calendar days to comply, where it is 8 weeks for a final decision on a complaint.
Welcome to LB by the way and good luck x

Re: claiming back ppi from debenhams store card that was taken out pre 2004
Hi Wilko,
I see my lovely friend Di has already given you an excellent advice.
You may consider waiting till you get your SAR before you start your complaint.
As Di pointed out, it will may take up to 40 days till you get it.
Do you remember how and why did your PPI appear?
In most cases the shop assistant filled in your form and asked you to sign.
In some cases they say you requested it later by the phone etc.
That is why it is very important to get your SAR in place for your information.
Then you will see what was written on your original application, if they still have it, whether you ticked the relevant box for PPI, whether the form was filled in by yourself or a shop assistant etc. You may also find some brief description of your telephone communications with them, which can be helpful, showing or not showing you requesting the insurance.
I started 2 of my complaints after seeing my SAR and it was very helpful. I found straight away a few irregularities there, which made my grounds stronger.
Your SAR usually will include the details of underwriters, which is important in case you might have to write them later. Also SAR will have the terms and conditions of PPI.
The template letter Di posted for you is perfect.
I used it myself on more than one occasion.
I suggest you send your letter and cheque for £10 by special or recorded delivery.
On two occasions companies claimed they did not receive my SAR letter.
However I had a prove that I did send it. Then they "found" my "mislaid" letter.
Santander is very difficult company to deal with, as Di pointed out.
However, eventually they give in if you are really determent. Please stay strong.
We have a special thread about Santander, which Di mentioned.
It has some useful information there as well.
The best grounds for complaint are if you can show that it is unlikely for you to make a successful claim, such as your employment status or pre-existing medical conditions etc., which can prove without a shadow of doubt that PPI was useless in your case as it could not cover you.
Good luck and keep us posted.
Best,
Victiria

Re: claiming back ppi from debenhams store card that was taken out pre 2004
Hi guys, Ihave already been rejected, I unfortunately didn't ask for the SAR form and went ahead with the application, they have come back advising that I didn't take out in shop even though I believe that I did, they advised that I took the Debenhams card out back in April 1995, they have also advised I got a phone call in August 1996 in which I purchased PPI on a non advised basis. They also advised that I received paperwork confirming sale.
I was thinking of sending Dizzy Di's letter to them to see if I can get back proof of what they have sent me in their letter, can you advise if this is a good idea or what other action I should take.
Thanks.
Angela

Personally I would still send the SAR letter. Then you should receive any details in which have been mentioned in their rejection letter.
Keep us posted - Good luck and don't give up !

Re: claiming back ppi from debenhams store card that was taken out pre 2004
Hi Angela,
I agree with Bazza , you should send for SAR.
It is very important, it will have to have all the details, including that telephone call, which you do not remember. It may well be they do not have any reference to gat call and that means they do not have any real proof you ever requested PPI.
Please send for SAR and get your case reopened based on new information which you get with your SAR.
The way I see it, they do not have any proof you requested PPI. Obviously if is not on your application form, which is good.
They cannot hide behind non advised sale because they had yo disclose all the relevant information before the sale was completed, not after. Receiving paperwork is usually by post, after the sale, not before, while the information about PPI for non advised sale has to be given prior the sale was completed to enable you yo make an informed decision.
You did not need that cover, you did not apply for it in the store when you got your card, so, why would you ask for it later over he phone? Did your personal circumstances dramatically change to make you decide to take an additional optional expensive financial product, which you did not need?
I don't think so.
Let's see what your SAR will show.
This rejection is not the end, but only a start, that is Santander, we are ready for a long battle - to win!

Re: claiming back ppi from debenhams store card that was taken out pre 2004
Hi Victoria, could you possibly send me link for the SAR letter to send to Santandar, I have seen a few different posts regarding Santandar being a very poor company to deal with and I am now determined to keep going.
Thank you guys for all your help.

Re: claiming back ppi from debenhams store card that was taken out pre 2004
Of course. Well done. You should keep going.
I'll find a template letter for SAR and will post it for you shortly.
When you send it, I suggest to take a photocopy of your letter and of your £10 check in the Post Office and ask the official there to witness it as well as to send it by Recorded or Special delivery.
In 2 cases Santander denied receiving my letters sent by special delivery, saying that either cheque was not enclosed or letter was not enclosed. I was warned they do such things for delaying the case and wearing you out, hoping you'll give up. Some people do. That is why I witnessed everything and they had to "find" my "mislaid" documents.
At least, please send everything to Santander by registered post and have all the copies anyway.
I'll find the template SAR and post it here for you.
Victoria

Re: claiming back ppi from debenhams store card that was taken out pre 2004
Hi Victoria & Bazza,
Firstly Happy New Year to you both.
I received back info from Santandar after sending for the SAR, not really clear, to be honest it's not really confirming anything, they just sent me a signed copy of my contract which I can't remember even doing, whether it was in Debenhams Store or by phone, they have also sent me copies of statements, apart from that this is all they have sent me, should I try to scan and send these to let you have a look at these? You might make more sense of them than myself.
Good news is Barclaycard have upheld another PPI Claim I had applied for, so easy to do, they just let me know a few days' ago they were upholding the claim, similar circumstances to Debenhams, couldn't remember even taking out the PPI policy but they would appear to be happy to pay me back any monies owing. Perhaps you could advise what my next step is and if you would like to see the paperwork that Santandar have sent me.
Thank you again for all your help guys.
Angela
