  • old PPI claims? blackhorse finance- claim handler or not?

    I have just posted this on the welcome forum but thought it may be viewed better if it was in the correct forum. Sorry to duplicate.

    To briefly outline, I have potentially got 4 PPI@-claims but they are mainly from about 2002. One of these I think have NO HOPE as its ppi on a repaid mortgage with 0bradford and Bingley. One of these I think I have LITTLE to NO HOPE as its ppi on a credit card which I queried at the time as I was working for mysself at the time which I thought made claiming futile. However I got behind on repayments and the debt was bought by another company, Robinson Way. Cred card was Capital One.

    The third. I thought was VERY HOPEFUL that is until I read posts on this forum albeit date written was pre 2011. This is ppi paid on a car loan with Chartered Trust which I believe was acquired by Black Horse Finance. I have original paperwork and was told at the time that I could not get the loan unless I took their ppi. I had asked if I could take out ppi with another firm as I felt it excessive.

    Finally the last one was also with Blackhorse Finance. It was around same time but I cannot find the papers on this as I lost a lot of my property when I was repossessed.

    So I need to know what my chances are and whether a xlaim handling company may be more successful as I have two young children and am a single mum with little time to hound and persist with this matter. I am however in a depressing amount of debt which I am being chased by bailliffs etc and would really benefit from winning a payout as would my kids who've been through hell and back and never had a holiday.at 7 and 4 years old are starting to wonder why all their other friends get holidays and day trips when they only get a day out on their birthday! Sorry the last bit isn't relevant I know but just to state how important this is.

    Hi Sarah.

    Personally we do not recommend using claims companies, there is in fact more work involved, like paperwork, it is also known it can take longer, and not only that you will also have to pay out so much to them from any refund due to you.
    The FSA/FCA also recommend doing this yourself, this way is all free - where if successful, you will get to keep all your refund.

    I note you said of the last one, is that the most recent loan? Can you remember the year you taken this out?

    Now with some being pre 2005, not all businesses were FSA regulated, so if this applies to you, the Financial ombudsman service (FOS) would not be able to take on your complaint, but they would instead suggest the underwriter/insurer of the business avenue, as being an insurer the FOS will take on the complaint as they have to be regulated as an insurer.

    Am so sorry for your issues and hope they all resolved very soon.

    If you no paperwork, you can if you wish (optional) request for all info held on your account via Subject Access Request (SAR), if you wish to do this let us know and we can post up the SAR letter template. They have 40 calendar days to comply, and you just enclose the one off payment of £10 cheque or postal order.

    You can however, check any loan account numbers on bank statements, of the account where the loan repayments were debited, your bank maybe able to track them down for you.

    When coming to the reclaiming side of it, you pursue the business who set up and sold the finance to you, if this fails due to the age of the account, then try the underwriter.
    Each business have their own complaints procedure, but they all have up to 8 weeks to give a final decision, on the final decision they should also confirm if your able to take complaint to the FOS as well, if eligible or not.
    Check on website of whom sold you the finance, they should have details of how to complain to them, and usually a ppi reclaim questonnaire form, they are mainly the same tforms for every business, but do follow their own procedures.

    Always keep copies of eveything for your records.
    Let them know every reason that applies to you for reclaiming.

    Once you sent the complaints off let us know how you get on and we can work out where from there, hope your successful, please keep us posted, good luck! :tinysmile_twink_t2:

      Wow. Am very impressed with your speedy reply despite being so late.

      Inyeresting comments on claims handlers. They give the impression they will get quicker results as they will chase them. Fir replies and decisions and will get quicker decisions.

      As for the company who sold me thethe finance, it was just the cart dealership. They were a rover. Dealers called Marshalls.

        Just wanted to let you know that I approached the car sales company who asked me to email details. I got a quick reply stating that they only kept records for 6 years so they have no details and therefore are not able to pursue the matter.

        I replied saying that it should not matter that they have no details because I have all the original paperwork. I then received an email from their solicitor as they had sought advice and they. Say that as it was so long ago I cannot claim.

        I must admit I always thought it was around 2001. When I bought this car but it was actually 1998. I have a sinking feeling that I read somewher that this may mean I cannot claim. Is he right?

        I had such hope on getting a claim since I had the original documents. Can you advice? Many thanks
