  • MBNA Credit Card PPI reclaim Success

    Hi,

    Just to let you know that today I have received a letter from MBNA advising that they have reconsidered my previous complaint in which was not up-held in November 2012, and after further review and their commitment to customers, they are now offering a gesture of goodwill amount of £448.97 ?

    Without looking a gift horse in the mouth, can someone kindly advise if the calculations (in relation to 8% simple amount) below look correct ?

    PPI premiums charged since sale date £375.85
    Total amount of associated interest £ 40.98
    Applicable 8% gross interest £ 40.17
    Less tax £ 8.03
    Total Payable £ 448.97

    They mention that in order to calculate your refund we have worked out how your balance over time would have changed if you had made the same monthly payments without PPI. Therefore we have;

    1) notionally reconstructed your statement balances by removing the PPI premiums and associated interest. This includes any interest arising because the balance on your account would have been higher with PPI; and

    2) if there is any statement period where, after reconstructing your account, there would have been a credit balance or a surplus payment then we have also added 8% simple interest on that amount.

    Does the above seem correct ?

    I do not have all statements but I do have a list of PPI payment amounts from March 2003 to December 2006 totalling £375.85.

    The account was transferred to MBNA from Alliance & Leicester in March 2003. As per my previous complaint, they confirmed that anything prior to that I would have to contact Alliance & Leicester / Santander in which I did and was again not up-held.

    YAY well done Bazza!!! GREAt work indeed, Congratulations!

    Now in my opinion looking at that, it does calculate correctly with the interest but hopefully Turbo our amazing calculator expert will be along soon to double check on this for you!!

      Cheers Di, I was quite shocked actually when I opened the letter this morning and of course I don't mind you asking lol.

      Well now's my next question, do I go and approach Santander / Alliance & Leicester on the back of details received today ? There maybe a problem though as I didn't go to FOS in time when it wasn't originally up-held (quite a mess at the time as firstly they had no details and then had the spiel letter of older than 6 years etc).

      This was an early claim when I was a bit inexperienced (so my fault really) with all the Fob off stuff but I have learnt a lot since then by using this site and you and everyone else's help and knowledge.

      And another couple of questions, would this be a coincidence as I recently sent MBNA an unfair Credit Card Charges letter do you think ? If I accept a full and final settlement from MBNA regarding PPI, will this effect the aforementioned ?

        Firstly Credit Card charges I do not assume them to be the same as PPI, do you have more details of the charges?

        So the 6 months dates has already passed to the FOS.
        Santander I believe you would have to write to, but as usual they may come back to say because account old they no longer hold records.
        They told me and others the same thing, and yet when I SAR's their DATA dept, the info arrived lol. They do mention the FLA, you could complain to after they dealt with your complaint, but the FLA will only investigate the complaint if you have more evidence not looked at by Santander, so you need to ask Santander at the same time to provide you with details of the Underwriter/insurer as mine would have been different to your's. (due to mine being a Capital One GE bank complaint) whom Santander also deals with on complaints.

        Do complain to them again first though, even if you have done before, but this time as said above request the details of the underwriter/insurer as this is something you never asked them for before, then let us know how you get on.

        A good friend of mine called Victoria was in the same position but then finally successful, so if you can also check the other thread posted sometime ago on here called "Post up your own experience with Santander" this may help you too.

          The unfair charges are in respect of late and over limit fees etc but still awaiting MBNA response to my letter. I just don't want to hinder the PPI offer if you know what I mean and perhaps someone may confirm. Or do I send a chaser or reply to MBNA asking if the matter is being dealt with separately ?

          Yes 6 months have passed and as mentioned they said they had no details. I did not SAR them so perhaps I should do now or shall I just write to Santander and ask for Underwriter / insurer details ?

            No harm in asking if the matter is being dealt with separately. But the letter in regards of your success should just be that of the PPI or they would have clarified otherwise, but if you want to be sure there is no harm done in asking them to confirm on this.

            What I done was both Bazza, I SAR'd the DATA dept of Santander as I wrote to the complaints dept, and yes do ask them to enclose details of the Underwriter at the same time.

              Yes I would of thought so but will be interesting to see how they reply as charges plus interest is a bit more than the final Payment Protection Insurance amount

              You don't think that they have now upheld my previous claim on the basis that they are going to reject my unfair credit card charges reclaim, or am I just being cynical ? :tinysmile_twink_t2:

              OK I will get an SAR off to Santander as soon as possible. Sorry to ask Di, what did you write to the complaints department ?

                Sorry can any of you calculator experts confirm if 8% simple has been applied correctly as per MBNA's comments ?

                  Your emails are full LOL.....

                  I know credit card interest works differently to loan ppi interest.
                  I'm sure turbo will be along at some point later, or possibly tomorrow now :tinysmile_twink_t2:, then he can clarify on this for you, but the bank should not discriminate you from making complaints or reclaims of other accounts as they should be classed as 2 separate issues, even on the same account.

                  I will try finding the contact details for you now as well, back as soon as lol

                  When i completed the Santander complaint form in, I also put in a separate cover letter to ask for the full details of the Underwriter, I made a point that we are entitled to have these details on request. x

                        You need to email the bloke I charge of the ppi department with mnb his name called Gavin email :cao_executive_complaints@bankofamerica.com I emailed and got a response in the hour he the main chief in the ppi section

                              Just to let you know that cheque received today for £448.97. Also there was an enclosed letter and it stated that if I banked it, it would not prejudice any query I had about my complaint or any other existing complaints
