I paid payment protection for five years to abbey national which then became santander. loan ended 2007 february. applied for ppi payment july 2013. was told that this was too late for them to retrieve any records. contacted solicitors who had all mortgage records 2001 TO 2007. they sent it to original address. never received the documents. solicitors said that those were the origInal records of mortgage and they did not have copies. THUS documents were lost. please advise.

i would suggest that that you write to Santander and request all information they hold on you via a subject access request (SAR). This will cost you £10.00.
Companies under current legislation are required to hold records of business for 6 years after the business is finished. So there is a possibility that Santander have destroyed their records; however I would doubt it.
Another option is to check out the direct debit mandates with your bank ( assuming that you are still with the same organisation ). By requesting a SAR from them, you are likely to be able to get the loan number, so then you can write to Santander with this. Again this will cost you £10.00 and under legislation, companies can take up to 40 days to get the information back to you. Of course, if they are very busy, they can take longer!!!!
if you are able to supply details of the loan number, maybe payments etc, then they have to deal with your complaint rather than try and fob you off.
if you put "Subject access request" into the internet, then a wording to follow will come up.

thank you for the advice. I did send the mortgage loan number to Santander. Their response finally was that it was past the six year period and they could not retrieve any records. Convenient for them as I was paying over GBP50 per month in protection fees which the mortgage broker said that I had to pay and that I would not be able to take out a mortgage without one being a first time buyer.

Under law, Santander must reply to a subject access request. It will cost you £10.00 and they must send you all the information they hold on you. Unless you send in a SAR, they can fob you off.

Afterfurther investigation, unfortunately we are not able to assist you in thisinstance with this particular case as your claim does not meet our currentcriteria.
Thereason for this is that after carrying out a ‘Subject Access Request’ to yourlender, we have had a response stating that they can no longer locate anyaccounts linked to yourself on their systems.
Thismay be due to the fact that your accounts were closed over 6 years ago.
Underthe Data Protection Act 1984 & 1998 lenders are not required to keepinformation for a period of 6 years post sale.

If however you can provide evidence of a policy in the form of acredit agreement or account number we will gladly reopen your case and resubmita complaint.
