Re: Halifax and PPI - Letter of rejection

        Thanks Di

I have written to Antorio via email and said that the actions of his PPI team (stalling) IMHO are bringing the bank into disrepute and argued that the pre-exiting medical condition and employment should negate ethe PPI cover. I used the FCA quote that Victoria provided as well.

I'll let you know what happens..

          Hi Di

Forgot to say I also have an Egg Loan where the PPI was added automatically to the loan amount (from 2003) - had a letter from Ian Clarke rejecting my complaint - I just have an agreement document with the Principal loan/Loan PPI Amount and total which I signed.

As the loan is regulated by the Consumer Credit Act 1974 - can I still make a claim? would my employment and pre-existing medical condition still count?

As far as Ian Clarke is concerned - should I go above his head to Michael Corbet?

Re: Halifax and PPI - Letter of rejection

            Dear Di

I have been sent at long last the Halifax documentation - please see attached - I can't see anything here that cancels my claim - do you have any ideas on the approach I should take? By the way I forgot to say that when you look through the documentation on page 3 - the section headed your employment was a contract role - i.e. temporary and I came out of that role 4 months later.

            Kind Regards

              Hiya
              Sorry for not replying sooner.

Did they mention the FOS (financial ombudsman service)?

You are able to take the complaint to the FOS as long as the business were FSA regulated at the time you taken out the loan, if this is not the case the FOS may suggest the underwriter/insurer avenue, so ask that business to send you details of the underwriter/insurer, once you receive these details let me know, because you can take a look at my letter I used for my underwriter which did succeed, it may help on yours, but first of all check if they were FSA regulated, as regulated by the CC Act 1974 will make no difference in that respect.:tinysmile_twink_t2:
You could try Michael Corbet by giving him say 7 or 14 days maximum and request for the details of the underwriter at the same time.

I am now checking your attachment x

Personally if you have exhausted all avenues with the business with this one including the CEO, I note you are able to take this complaint to the FOS. Maybe this would be the best way forward if you have also been in touch with the CEO but they not backing down, but......do you get on well with your local MP?
If so maybe he or she could write to the CEO on your behalf, but make sure you dont lose out on the 6 month timescale given to take to the FOS.

This will be from the date of the final rejection letter....

                  Hi Di

Did you get an opportunity to look at the Halifax Demands and Needs documents I added (2 posts above?) - just curious about the approach I could take?

                  Kind Regards

Re: Halifax and PPI - Letter of rejection

On checking on this, I do see what you mean about the cancelling, and not able to see anything, unless i missed something, but the fact that you were just temporary its not stating anywhere if you would be eligible or not, maybe its worth asking if they stil hold any terms and conds of what is covered and what is not, yet you may be lucky to find these details online on google search.
I note you said you were not in that role after 4 months, can you remember updating them on this change, was it just part time hours, for eg 16 or 18 hours, if so then it may have been worthless to you. Did you try to cancel the ppi before did you say?
(saying that I am not sure if it makes any difference if the job role changes, but if the hours were just part time, they may not have paid out on a claim if one was to be made).
If the temp work was not long term I would try checking out the terms and conds for this as this may not have covered you, and at least you do have that chance of sending them more info before going to the FOS.

Also if other things applied to you at the time of taking out the policy, for eg like a pre-existing med condition that is another they probably not paid out on a claim.
