        Mr DT has eventually had his op but has had a rough time of it, improving now and he should be back driving me mad soon!
        Had another try with Aviva but no joy possibly due to the fact there is no proof or documents for this one but not giving up xx

          Update - not good news - Aviva (Chief Executive's Office) have rejected claim "because your policy was sold after Welcome Finance) became a member of the GISC. This means WFS are responsible for the sale of their policies. I have sent them details of your complaint and asked them to contact you about this."

          Now full circle - WFS blame the broker, broker gone bust and not covered by FSCS, Aviva point to WFS!!! Needless to say had no contact from WFS in last 3 months.
          Any advice welcome!! ARGH!! anything but that word

            Hi pressandgo,

            I am in a very similar situation as you but further down the line - I feel your frustration but must warn you that it does not get any easier when dealing with this lot, so be prepared for a fight !

            Was your broker Dial4ALoan by any chance ? Do you have any broker details where you signed confirming that you agreed to PPI ? Let me know as would be interested to see if similar to mine.

            My claim is currently with the FOS adjudicator (over a year now) and proceeding to be reviewed by the Ombudsman after being rejected due to the fact that the broker was unregulated (hence my original complaint against Welcome) and that they cannot establish any agency relationship.

            I have provided evidence of internal secret commissions / brokerage payments between broker and lender (all in house) that were never disclosed to me as the borrower yet FOS has totally ignored when raised.

            I did try the Underwriter option but had the same rejection as you and even when suggested by the FOS adjudicator they decided to dismiss it on the basis of the relationship issue again.

            What frustrates me is that my original complaint was with Welcome as they were GISC regulated at the time of sale and the insurance was added as part of their agreement, in which was useless to me at the time.

            There has been no proof or evidence that the insurance was sold or added by the broker Dial4ALoan, apart from what was later disclosed as part of the commission / brokerage sheets as part of my Subject Access Request.

            The up-front single premium insurance was added to the Welcome agreement on the basis for the loan to be agreed but there was no advice or details provided of what the policy covered at the time of sale. Again I had to request details from the policy administrator Direct Group and when received it was on Welcome Finance headed paper ?

            So as mentioned before, be prepared for a battle !

                  I've searched archives on PAG where Tanz found that Welcome Finance were members of gisc earlier than quoted---but alas--I can't find the thread

                    I've already had confirmation from Welcome that they were GISC regulated from February 2003 before I took the loan out.

                    The issue I have is that FOS are only addressing the broker sale of PPI and unless a relationship is proven then no other party is responsible and claim will be rejected.

                      Hi all'

                      I had hoped it was now time to progress my hope to dissolve this secured Welcome Finance Loan I am apparently Tied into and have been told for many years now that this is the case. After the news today that new rules had been pushed through parliament in relation to "Other Unscrupulous Finance Co" It also appears to be another load of rubbish.

                      So I found myself here... I'm afraid to say is it not that chasing them all / Brokers / Insurers etc., The Instructions as outlined here in Questions and Answers for FSCS.org in relation to Welcome Finance shows Nothing can be achieved. THE RULES "That have been agreed". are unmatchable. They Cannot be Met and to add to that they even state that it will not be refunded but will be deducted. Like thanks a bunch. Deducted from the Total Amount payable. To me that is offensive and supports this entire countless miss managed / illegal drawn up / Insurance as PPI / Accumulated Interest.

                        Not made any progress on this, just sorted out a claim with Lloyds for son-in-law - successfully. Not sure of what action to take.

                        Broker was Best Car Credit, Norwich - FSCS say cant help, Welcome deny involved and underwriter refered me back to Welcome. FOS a possible route or court action (the great unknown. Need to get my mind round this.

                          Nor have I pressandgo.
                          As you know, in a long dispute with them and yesterday received two letters ssaying they had charged the wrong interest and were refunding just short of £3k to and account that they have never supplied any proof of.
                          Apparently it was rewritten in 20004 the year after we did have a loan with them, we have the aer work for this and both CAB and LB (and
                          Welcome themselves say it is unenforceable (CAB irretrievably so):target:
                          Not sure what to say as it looks like yours was one of the car loans but good luck!

                            Also on what basis did Welcome say that it is now enforceable ?

                              Yes it was secured.
                              No they have not said enforceable, they tried though been advised by LB to ignore the letter.
                              They admitted they could find no documents and this refund is just fantasy money in my view
                              Never give up, Never surrender.
