  • PPI A&L confusion help needed!

    Hello,
    thanks in advance to anyone that can help with advice.
    I have recently been trying to sort out and get on top of my direct debts etc by using on line banking (yes i know where have i been the moon!)
    I've got myself very confused. (not hard these days)
    I had 4 DD's I was unsure about. I phoned the companies involved, asked them to send me details etc which they have done. It turns out after alot of digging...
    Back in 2007 we changed our mortgage to Alliance and Leicester. Its seems that we bought 4 insurances from A&L??
    Life insurance - fine remember that one and happy to keep it
    Me - critical illness - remember looking through the documents my husband brought home for me to sign - fine cant moan about that as i knew but have now cancelled it
    joint - Sterling - sold by A&L - Personal Accident plan??? 10.45 per month?????we have no idea what so ever how we got this at all, we don't need it or wont it? it started two months after the mortgage. reasons for not wanting it below
    Joint - Mortgage payment cover - cardif pinnacle - again sold by A&L.
    Got a review in front of me, the whole page has "review of your PPI insurance - £27.84 and i have PPI on top of that!! 6.96???

    I phoned santander, they logged the complaint (the complaint is based on my husband having type 1 diabetes for 44 years and asthmatic both have seen him in hospital) also the fact that we cant remember ever agreeing to these policies. (life insurance and critical illness yes)
    2 we don't need them! i work in local government he works for a bank, we both get very good sickness pay and very good redundancy packages if needed.
    They wrote back saying they couldn't find any policies as over 6 years old, case closed! I said i will write to you will all documentation including the letters that i had requested from cardif and sterling confirming you sold me these, how much I paid when they started and ended. Today they wrote, saying, you did no fill in your questionnaire (never got one) you have seven days or case closed.

    what I need help with is, do i stand any chance on re-claiming these policies I never wanted, never knew I had, didn't need, no idea how they were sold?! and mostly we probably couldn't claim due to existing medical conditions? Or am i banging my head against a brick wall?

    Sorry to write so much I just don't know where to start with these companies!

    Hi and welcome

    It appears that you are dealing with Santander!
    There is a thread here amongst the ppi section "of your own experience of dealing with Santander" now they seem to be rejecting lots of reclaims if they are longer than 6 years old and will use the same old excuse that they hold no info etc....

    With mine, it just goes for show they never check with their data dept, but I requested info by forms of a Subject Access Request (SAR) from Santander data dept and all the info required did arrive, but then the excuse was, as its over 6 years old blah blah!

    However, you may still stand a chance with the fact that yours was taken out in 2007 and as long as you still have info that is fine, as they have something to work on and not only that mine was from the mid 90's, so there is a big difference there.
    They have not exactly got a good record on handling complaints but yours would have been regulated by the FSA if taken out in 2007, so if this is the case, if they keep rejecting by the time you they get to the final decision, you do have the Financial ombudsman service (FOS) who you can pass this on to to investigate.

    I note you said you had contacting them, did you try to do so in writing or just telephone call? xx

    I would complete the complaint form and get it into them, because they are also supposed to confirm if your able to complain to the FOS as well, in my opinion you have very good strong grounds to reclaim x

      Hello and thank you very much for taking the time to reply. Originally I phone but only to find more details regarding policies sold via the complaints dept. I told the caller my issues and they ask if I'd like to make a complaint over the phone. I did say well shouldn't i do this in writing and they said no you can do this over the phone if we need any more info then we will send you a questionaire. Well that sounded easy but now I'm getting letter saying they have no policies blah blah as they do. Luckily I have proof. Kept all corespondance from all parties etc. I'm just a little worried I won't word it all correctly or "intelligently" enough to be taken seriously. Again thank you x

        Your welcome and good for you for referring this into writing.

        If you check on the website below, there is also a complaints form you can complete unless you prefer to write a letter.
        Just tell them you are raising this matter in writing in regards of a policy sold to you on XX/XX/2007 and have also attached a (copy) of some relevant information, give your reasons on why you are requesting for a ppi refund and all interest that applies to the account, also confirm they have 8 weeks to issue you with a final decision. I would also state that you are aware that when the policy was sold to you in 2007 that they were FSA regulated and you will have the right to complain to the FOS to take matters further if they fail to uphold your complaint.

        Good luck and remember to keep copies for your own records, also send by signed for delivery, because this business have a bad habit of saying they have not received anything.
